NOTIFICATION
New Delhi, the 8th January, 2025
S.O. 142(E).-Whereas, pursuant to the provision of Section 14 of the National Highways Authority of India
Act, 1988 (68 of 1988), the National Highways Authority of India (hereinafter referred to as the "Authority")
entered into agreement on 31.03.2011 & Supplementary Agreements dated 07.02.2019 with M/s Raebareilly
Allahabad Highways Pvt. Ltd. (hereinafter referred to as the "Concessionaire") for the development of Raebareilly-
Allahabad section from km 82.700 to km 188.600 (Design Chainage 0.700 to km 106.517) on National Highway No.
24B in the State of Uttar Pradesh (hereinafter referred to as the "said section") to two lane standards with paved
shoulders on Design, Build, Finance, Operate and Transfer (DBFOT) basis;
Whereas, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of
1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the
Central Government vide notification 1697 (E) dated 06.05.2019, having regard to the expenditure involved in building,
maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the
volume of traffic and the period of the agreement entered into between the Authority and the Concessionaire,
authorized the concessionaire to collect fees on mechanical vehicles for the use of the said section at sixty per cent of
the base rate, from the date of commercial operation or publication of this notification in the Official Gazette,
whichever is later, till the termination date as specified in the agreement;
Whereas, due to defaults by the Concessionaire and subsequent suspension, the Authority took over user fee
collection on the said section through a designated agency.
And whereas, the said section being under widening to four/six lanes, the Authority has requested the
Ministry of Road Transport and Highways to temporarily suspend user fee collection at both Etaura and Andhiyari
fee plaza.
Now, in exercise of the powers conferred by Section 8A and Section 7 of National Highways Act, 1956 (48
of 1956) read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the
Central Government hereby temporarily exempts the user fee collection for said section notified under Gazette
Notification bearing S.O.1697 (E) dated 6th May, 2019 for the period from 9th January 2025 to 28th February 2025.
Accordingly, previous notification number S.O. 1697€ dated 6th May, 2019 for user fee collection on said
section stands rescinded from 9th January 2025 to 28th February 2025.
