EXTRAORDINARY PART II —Section 3 —Sub-section ( i) PUBLISHED BY AUTHORITY No. 570] NEW DELHI, FRIDAY , OCTOBER 6 , 2023/ ASVINA 14, 1945 CG-DL-E-07102023-249265 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 5th October, 2023 G.S.R. 723(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 110 of the Motor Vehi cles Act, 1988 (59 of 1988), is hereby published as required b y sub -section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public; The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government. 3. Short title and commencement - (1) These rules may be called as the Central Motor Vehicles (……Amendment) Rules, 2023. (2) Save as otherwise provided in these rules, they shall come into forc e on the date of their final publication in the Official Gazette. 2. In sub rule (3) of rule 15 of the principal rules, in clause (a), in clause (f), in clause (r) and in sub -clause (ii) of clause (v); for the words "rear -view mirror", the words " rear-view mirror or devices for indirect vision " shall be substituted; 3. In rule 31 of the principal rules, in sub -rule (1), in Table A, in Sr. No. 2, for the words "Rear -view mirror", the words " Rear -view mirror or devices for indirect vision " shall be substituted; 4. In rule 62 of the principal rules, in Sr. No. 6 of Table A of sub -rule (1), for the words "Rear View Mirror", the words " Rear view mirror or devices for indirect vision " shall be substituted; 5. In rule 124 of the principal rules, a. in sub -rule (4), in Table, in Sr. No. 8, for the words "rear -view mirror", the words " devices for indirect vision " shall be substituted; 7. In rule 125, for sub-rule (2) the following sub -rule (2) shall be substituted, namely: - “(2) Six months from the date of commencement of the Central Motor Vehicles (Amendment) Rules 1993, all motor vehicles shall be equipped with rear view mirror or devices for indirect v ision. Provided that - (a) for L5 category (three wheeled vehicles) without body work and L1 and L2 categories (two wheeled vehicles) manufactured on and after the 1st day of October, 2019, the rear view mirror specification and installation requirements shall be as specified in AIS -001 (Part 2) (Rev.1):2011 and AIS -002 (Part 2)(Rev.1):2011 standard respectively, as amended from time to time, till such time the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016); (b) for L5 category (three wheeled vehicles) with body work manufactured on and after the 1st day of October, 2019, the rear view mirror specification and installation requirements shall be as specified in AIS -001 (Part 1) (Rev. 1): 2011 and AI S-002 (Part 1) (Rev. 1): 2011 standard respectively, as amended from time to time, till such time corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016); (b-1) for L5 category (three wheeled vehicles) wit h body work manufactured on and after the twelve months from the date of Amendment (…), the devices for indirect vision specification and installation requirements shall be as specified in AIS -001 (Part 1) (Rev. 2): 2023 and AIS -002 (Part 1) (Rev. 2): 2023 standard respectively, as amended from time to time, till such time corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016); (c) for M and N category vehicles manufactured on and after the 1st day of Octo ber, 2019, the rear view mirror specification and installation requirements shall be as specified in AIS -001 (Part 1) (Rev. 1): 2011 and AIS -002 (Part 1) (Rev. 1): 2011 standard respectively, as amended from time to time, till such time corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016): (c-1) for M and N category vehicles manufactured on and after the twelve months from the date of Amendment (…), the devices for indirect vision specification and instal lation requirements shall be as specified in AIS -001 (Part 1) (Rev. 2): 2023 and AIS -002 (Part 1) (Rev. 2): 2023 standard respectively, as amended from time to time, till such time corresponding BIS specifications are notified under the Bureau of Indian St andards Act, 2016 (11 of 2016): Provided further that, for L7 category vehicles manufactured on and after the 1st day of October, 2019, the rear view mirror specification and installation requirements shall be as specified in AIS -001 (Part 1) (Rev. 1): 201 1 and AIS -002 (Part 1) (Rev. 1): 2011 standard respectively, as amended from time to time, till such time corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016). Provided further that, for L7 category veh icles manufactured on and after the twelve months from the date of Amendment (…), the devices for indirect vision specification and installation requirements shall be as specified in AIS -001 (Part 1) (Rev. 2): 2023 and AIS -002 (Part 1) (Rev.2): 2023 standa rd respectively, as amended from time to time, till such time corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016). Provided also that on and after the 1st October, 2019, for agricultural tractors, the r ear view mirror specifications and installation requirements shall conform to AIS -001(Part 1)(Rev. 1) :2011 and AIS:114 -2009 respectively, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Stand ards Act, 2016 (11 of 2016). Provided also that on and after the, for agricultural tractors manufactured on and after the twelve months from the date of Amendment (…),, the devices for indirect vision specifications and installation requirements shall conform to AIS -001(Part 1) (Rev.2): 2023 and AIS:114 -2009 standards respectively as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016). Provided also that on and from th e 1st April 2017, articulated or truck -trailer or tractor -trailer vehicles engaged by automobile manufacturers to carry motor vehicle from their factories to different sale outlets in the country, shall be equipped with a rear surveillance camera -monitorin g device or rear view camera. ” 8. In rule 125 -A, for the entry “rear view mirror”, wherever it occurs, the entry “rear view mirror or devices for indirect vision ” shall, respectively, be substituted; 9. In rule 125 -C, a. in sub -rule (3), in Table 1, in Sr. no. 22, for the words "Rear view mirror", the words " Rear view mirror or devices for indirect vision " shall be substituted; 10. In rule 128, a. in sub -rule (13), in clause ( i) for the words "rear view mirror", the words " rear view mirror or devices for indirect vision " shall be substituted. 11. In Form 22 -B, a. in part A, in Sr. 6.22 for the words "rear view mirror", the words " rear view mirror or devices for indirect vision " shall be substituted. 12. In Motor Vehicles (Driving) Regulations, 2017 (a) for the entry “rear view mirror”, wherever it occurs, the entry “rear view mirror or devices for indirect vision ” shall, respectively, be substituted.
