The Ministry of Road Transport and Highways published draft rules, G.S.R. 724(E) dated 5th October 2023, under section 110 of the Motor Vehicles Act, 1988 (59 of 1988), to be called the Central Motor Vehicles Amendment Rules, 2023, inviting objections and suggestions under section 212(1) within thirty days to the Additional Secretary (MVL&Transport), Ministry of Road Transport and Highways, or by email to [email protected]; the draft, to come into force eighteen months after final publication, proposes to omit the requirement in rule 47(1)(g) for self-certification of bus bodies built on drive-away chassis via Form 22B and to omit Form 22B itself; renumber rule 47(5) as rule 47(6) and insert a new proviso requiring bus body builders to upload bus body details on the portal vahan.nic.in/makermodel; insert a new proviso in rule 125-C(1) requiring testing and approval of bus bodies with seating capacity of 13 or more per AIS:052 (Revision 1)-2008 until corresponding Bureau of Indian Standards specifications are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016); add a clause in rule 125-C(7) Table 1 requiring buses exceeding 22 seats to meet AIS-153 until BIS specifications are notified; and omit the tenth and eleventh provisos under rule 126; the principal Central Motor Vehicles Rules were published vide G.S.R. 590(E) dated 2nd June 1989; signed by Mahmood Ahmed, Addl. L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( i) PUBLISHED BY AUTHORITY No. 571] NEW DELHI, FRIDAY , OCTOBER 6, 2023/ ASVINA 14, 1945 CG-DL-E-07102023-249255 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi , the 5th October , 2023 G.S.R. 724(E).—The following draft rules to further amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by Section 110 of the Motor Vehicles Act,1988 (59 of 1988) is hereby published as required by sub -section (1) of Section 212 of the said Act for information of all persons l ikely to b e affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of this notification, as published in the Gazette of India, ar e made ava ilable to the public. 2. The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government. 3. Objections and suggestio ns to these draft rules, if any, may be sent to the Additional Secretary (MVL&Transport), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi -110 001 or on the email: comments [email protected]; Draft Rules 1. Short title and commencement. — (1) these rules may be called as the Central Motor Vehicles (………. Amendment) Rules, 2023. (2) This notification shall come into force on and after eighteen months from the date of final publication of Amendment in the Official Gazette. 2. In the Central Motor Vehicle Rules( CMVR), 1989 (hereinafter referred to as the said rules), in rule 47, sub -rule 1, clause g, the following words, figures and letters shall be omitted, namely: - “and, in case of self -certification of the bus body built on a drive away chassis by a bus body structure fabricator, certificate of compliance in Form 22B” 3.In the said rules, Form 22B shall be omitted. 4.In the said rules, in rule 47, sub -rule 5 with words and figures “on and from …. on the portal” shall be re numbered as sub -rule 6. 5.In the said rules, in rule 47, the sub -rule 6, the following proviso shall be inserted, namely: - “Provided that, every bus body builder shall upload the bus body details against the relevant drive away chassis on the po rtal ht tps://www.vahan.nic.in/makermodel.” 6.In the said rules, in rule 125 -C, in sub -rule 1, after first proviso, following new proviso shall be inserted namely: - “Provided further that, the testing and approval of body building of buses with seating c apacity of 13 or more passenger excluding driver, by bus body builder shall be in accordance with AIS:052 (Revision 1) -2008, as amended from time to time, for vehicles mentioned therein, till the corresponding BIS specifications are notified under the Bure au of In dian Standard (BIS) Act,2016 (11 of 2016),and shall be type approved by the Test Agencies specified under Rule 126 of CMVR 1989.” 7.In the said rules, in rule 125 -C, in sub -rule 7, Table 1, following new clause c inserted namely: - “(c) the buses w ith seat ing capacity exceeding 22 passenger excluding driver, built by bus body builder shall meet the requirements as per AIS -153, as amended from time to time, for vehicles mentioned therein, till the corresponding BIS specifications are notified under t he Burea u of Indian Standard (BIS) Act, 2016 (11 of 2016). 8.In the said rules, in rule 126, “10th and 11th provisions under CMV Rule 126 shall be omitted.” [F.
