Detailed Summary

Pursuant to sub-sections (1) and (2) of section 3D of the National Highways Act, 1956 (48 of 1956), the Central Government, Ministry of Road Transport and Highways, declared vide S.O. 3838(E), dated 6 September 2024, that the additional land specified in the Schedule should be acquired, vesting absolutely in the Central Government free from encumbrances upon publication, for construction (widening/two-lane with paved shoulder/four-laning), maintenance, management and operation of National Highway NH-92 in the stretch from Km. 30.00 to Km. 57.346 (Near Karri Village to Etawah section), in Etawah district, Uttar Pradesh. This follows the prior declaration of intent under section 3A(1), S.O. 1956(E) dated 8 May 2024, whose substance was published in "Navbharat Times" (Hindi) and "Times of India" (English) on 17 May 2024 under section 3A(3); objections received were considered and disallowed by the Competent Authority, which submitted its report to the Central Government. The Schedule lists fourteen affected private agricultural plots (survey numbers 1189, 1191, 1205, 245, 246, 247, 248, 742, 743, 969, 970, 973, 975, 977) totalling 0.3239 hectares in Bahadurpur Luhiya village, Etawah taluk, together with the names of landowners/interested persons. PIU-MoRT&H/FRK/NH -92-I/LA/2020 -21/3D ] MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 6th September , 2024 S.O. 3838(E).— Whereas by the notification of the Government of India in the Ministry of Road Tra nsport and Highways, 1956(E) Dated:08/05/2024 , published in the Gazette of India, Extraordinary, Part II, Section 3, Sub - section (ii) issued under sub -section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for construction (widening/two lane with paved shoulder/four laning etc.) Maintenance, management and operation of NH-92 in the stretch of land from Km. 30.00 to Km. 57.346 (Near Karri Village to Etawah section) in the district of ETAWAH in the state of UTTAR PRADESH, hereby declares its intention to acquire such land. And whereas the substance of the said notification has been published in “Navbharat Times” (Hindi) and “Times of India” (English) both dated 17.05.2024; under sub -section (3) of section 3A of the said Act; And whereas objections have been received and the same have been considered and disallowed by the Competent Authority; And whereas, in pursuance of sub -section (1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by the sub -section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose; And further, in pursuance of sub -section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.
