NOTIFICATION
New Delhi, the 6th April, 2026
F. No. PLG/MP/0091/2022/F-20.— In exercise of powers conferred by Section 57 of Delhi Development Act,
1957 (61 of 1957), the Delhi Development Authority, with the prior approval of the Central Government, hereby makes
the "Regulations For Transit Oriented Development (TOD) and Charges, 2026"
1. SHORT TITLE AND COMMENCEMENT
1.1. These regulations shall be called the “REGULATIONS FOR TRANSIT ORIENTED DEVELOPMENT
(TOD) AND CHARGES, 2026"
1.2. These regulations shall come into force with effect from the date of publication of this Notification in the
Gazette of India.
1.3. All words and expressions used in these Regulations but not defined shall have the meaning assigned to them
in the Delhi Development Act, 1957, the Master Plan in force, and the Delhi Municipal Corporation Act, 1957
and the New Delhi Municipal Council Act, 1995, as the case may be.
1.4. If any question arises relating to the interpretation of these Regulations, it shall be decided by the Central
Government.
2. DEFINITIONS
2.1 "TOD Charges"- Charges to be paid by the Developer Entity to DDA for Base FAR of 400 for undertaking
area improvement and infrastructure augmentation works (as required).
2.2 "TOD Fund"- An Escrow account setup by DDA to utilise the TOD Charges & Additional FAR Charges
accrued from TOD Schemes. The TOD Fund shall be ring-fenced for undertaking area improvement and
infrastructure augmentation works (as required).
2.3 "Additional FAR Charges" – Charges to be paid by the Developer Entity to DDA for Maximum FAR
beyond 400 (till maximum permissible FAR of 500) as per prescribed rates.
3. TOD CHARGES
3.1 DE shall pay TOD charges to DDA for Base FAR of 400 at the uniform rate of Rs. 10,000 per Sq. Meter of FAR
Area of TOD Plot for all categories of colonies.
3.2 The above charges include Infrastructure Development Charges for Water & Sewer of DJB, Plan Sanction Charges
of MCD including Charges for Land Use Change & Levy/Addl. Levy/Add. FAR and DDA Charges for conversion
from Lease Hold to Free Hold and no separate charges shall be collected for the same. However, individual plots
forming part of a consolidated TOD plot, held on a leasehold basis shall, upon full payment of all outstanding dues
(including ground rent, enhanced ground rent, interest on ground rent, composition fee, damage, misuse charges,
unearned increase etc.) and provided that such plots are free from all encumbrances (including loan, mortgage,
litigation etc.), be deemed to be freehold, excluding Institutional Plots held on a leasehold basis.
3.3 The TOD Charges are subject to revision from time to time and this charge shall remain in force until further orders
are issued by MoHUA.
3.4 These Charges shall be deposited at the time of submission of TOD Scheme through the OBPS of MCD, and shall
be ring-fenced through an Escrow account in a dedicated TOD Fund for undertaking area improvement and
infrastructure augmentation works (as required).
3.5 The distribution of the composite TOD charges of Rs. '10,000 per sq.m shall be as follows:

4. TOD FUND
4.1 The TOD Charges (for Base FAR of 400) and additional FAR Charges (as required for FAR beyond 400) shall be
ring-fenced by DDA through an Escrow account in a dedicated TOD Fund.
4.2 The concerned local bodies/ DDA/ service providing agencies shall commission and execute the various area
improvement works utilising the TOD Fund and any other charges collected during approval of TOD Schemes.
4.3 The apportionment of TOD Fund between various service providing agencies and local bodies shall be as per the
approval of MoHUA.
4.4 The TOD Fund shall be used only for area improvement and infrastructure augmentation works, and not on
expenditure of any other kind such as salary disbursement, etc.
5. ADDITIONAL FAR CHARGES
5.1 FAR beyond 400 shall be permissible only after payment of Additional FAR Charges to DDA at the rate of 20% of
the prevailing Circle rates, applicable to all colonies of Delhi as notified by the Department of Revenue,
Government of the National Capital Territory of Delhi, in addition to payment of TOD Charges.
5.2 The additional FAR Charges are subject to revision from time to time and the charges shall remain in force until
further orders are issued by MoHUA.
5.3 These Charges shall be deposited at the time of submission of TOD Scheme through the OBPS of MCD, and shall
be ring-fenced through an Escrow account in a dedicated TOD Fund for undertaking area improvement and
infrastructure augmentation works (as required).
