Detailed Summary

In S.O. 1097(E) dated 6th March 2024, the Ministry of Road Transport and Highways issued a final declaration under sub-sections (1) and (2) of Section 3D of the National Highways Act, 1956 (48 of 1956), confirming acquisition of land for construction, maintenance, management and operation of a Toll Plaza on National Highway 120 in the Nasariganj Bypass Section, from Km 181.465 to Km 201.665, in Rohtas district, Bihar; the notification follows the Ministry's original intention-to-acquire notice No. 2545 dated 9th June 2023 issued under Section 3A, whose substance was published in Hindustan Rohtas on 7 July 2023 and Dainik Jagaran Gaya on 8 July 2023, after which the Competent Authority-cum-District Land Acquisition Officer, Rohtas received and settled objections filed under Section 3-C and submitted its report under Section 3D(1); the Schedule lists a total of 2.216 hectares spanning 30 survey/plot parcels in Village Basdiha (Taluk Karakat) and Village Baliya (Taluk Nasariganj), comprising private agricultural, residential and government road/canal land, which vests absolutely in the Central Government free of encumbrances upon publication; the order is signed by Abhay Jain, Deputy Secretary, under File No. RW/PAT/NH/120/GOH-DAUDNAGAR-NASRIGANJ-DAWAT-DUMRAON section/LA/2021/3D.

No. RW/PAT/NH/120/GOH - DAUDNAGAR-NASRIGANJ - DAWAT - DUMRAON section/LA/2021/3D] MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 6th March, 2024 S.O. 1097(E).—Whereas by the notification of the Government of India in the Ministry of Road Transport and Highways, 2545 Dated:09/06/2023, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for construction of Toll Plaza Maintenance, management and operation of NH120 in the stretch of land from Km. 181.465 to Km. 201.665 (Nasariganj Bypass Section) in the district of ROHTAS in the state of BIHAR And whereas the substance of the said notification has been published in “Hindustan Rohtas Dated 07 Julay 2023” and “Dainik Jagaran Gaya” dated 08 July 2023; under sub-section (3) of section 3A of the said Act; And whereas the Competent Authority has received objections filed under Section 3-C, considered and settled the same appropriately; And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority-cum-District Land Acquisition Officer, Rohtas has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose; And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.
