By notification S.O. 540(E) dated 6th February 2024, the Ministry of Road Transport and Highways, Government of India, declares under sub-sections (1) and (2) of section 3D of the National Highways Act, 1956 (48 of 1956) that land specified in the Schedule shall be acquired and shall vest absolutely in the Central Government, free from all encumbrances, for building (widening/four-laning etc.), maintenance, management and operation of NH17 in the stretches from Km 0.00 to Km 5.873, Km 6.340 to Km 17.605, and Km 17.695 to Km 17.737 (DC Office, Dhubri) in Dhubri district, Assam; this follows the earlier declaration of intent to acquire under section 3A of the Act made vide notification S.O.06(E) dated 29th December 2023, whose substance was published in the newspapers Niyomiya Barta and The Assam Tribune both dated 25th January 2024, the Competent Authority's consideration and settlement of objections filed under section 3-C, and the Competent Authority's report submitted to the Central Government under section 3D(1); the Schedule lists specific survey/plot numbers, land types, nature of land, area in hectares, and named landowners in Chirakuti Pt I village, Chapor taluk, Dhubri district. MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 6th February, 2024 S.O. 540(E).—Whereas by the notification of the Government of India in the Ministry of Road Transport and Highways, S.O.06(E) Dated:29/12/2023 , published in the Gazette of India, Extraordinary, Part II, Section 3, Sub- section (ii) issued under sub-section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intension to acquire the land specified in the Schedule annexed to the said notification for building (widening/four-laning, etc.), maintenance, management and operation of NH17 in the stretch of land from Km. 0.00 to Km 5.873, Km 6.340 to Km 17.605 and Km 17.695 to Km 17.737 (DC Office, Dhubri) in the district of DHUBRI in the state of ASSAM. And whereas the substance of the said notification has been published in “Niyomiya Barta” and “The Assam Tribune” both dated 25.01.2024; under sub-section (3) of section 3A of the said Act; And whereas the Competent Authority has received objections filed under Section 3-C, considered and settled the same appropriately; And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by the sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose; And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.
