On 5 December 2024, the Ministry of Ports, Shipping and Waterways issued G.S.R. 752(E) under sub-section (1) of Section 7 and Section 80, read with clauses (zv) and (zza) of sub-section (2) of section 106, of the Inland Vessels Act, 2021 (24 of 2021), publishing for information, per sub-section (1) of section 106, draft amendments to the Inland Vessels (Crew and Passenger Accommodation) Rules, 2022 (originally G.S.R. 423(E), dated 7 June 2022), to be titled the Inland Vessels (Crew and Passenger Accommodation) (First Amendment) Rules, 2024, with objections or suggestions invited within thirty days of public availability, addressed to the Director (IWT), Ministry of Ports, Shipping & Waterways, Room No. 251, Transport Bhawan, 1-Parliament Street, New Delhi-110001, or by email to [email protected] and [email protected]; the draft amendments add a gross-tonnage-calculation explanation to rule 2 referencing the International Convention on Tonnage Measurement of Ships, 1969 (for vessels above 24 metres) and the Merchant Shipping (Tonnage Measurement of Ships) Rules, 1991 (for vessels below 24 metres); revise the seating-capacity factor in rule 20(1) from 0.60 to 0.36; revise passenger-seating requirements in rule 23(3) for voyages of more than 15 and up to 60 minutes, referencing the Inland Vessels (Design and Construction Rules), 2024; amend access/escape clear-space dimensions in rule 24 (minimum width 750 millimetres; figures revised from 1600 to 1300 mm, 680 to 650 mm, 310 to 230 mm, and 620 to 480 mm); amend rule 26(6) to remove the words "or individual unit type" and add a case-by-case exemption proviso for Category A vessels under 300 GT; and revise the figure in rule 31(4) from 30 to 60. L.-33004/99 The Gazette of India CG-DL-E-06122024-259204 No. 690] EXTRAORDINARY PART II-Section 3-Sub-section (i) PUBLISHED BY AUTHORITY NEW DELHI, THURSDAY, DECEMBER 5, 2024/ AGRAHAYANA 14, 1946 7899 GI/2024 MINISTRY OF PORTS, SHIPPING AND WATERWAYS NOTIFICATION New Delhi, the 5th December, 2024 G.S.R. 752(E).— In exercise of the powers conferred by sub-sections (1) of Section 7 and Section 80 read with clauses (zv) and (zza) of sub-section (2) of section 106 of the Inland Vessels Act, 2021 (24 of 2021), the Central Government proposes to amend the Inland Vessels (Crew and Passenger Accommodation) Rules, 2022 notified by the Government of India in the Ministry of Ports, Shipping and Waterways vide number G.S.R. 423(E) dated the 7th June, 2022 and hereby publish as required by sub-section (1) of section 106 of the Inland Vessels Act, 2021 (24 of 2021) for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification, as published in the Official Gazette, are made available to the public; Objections or suggestions, if any, to these draft rules may be sent to the Director (IWT), Ministry of Ports, Shipping & Waterways, Room No. 251, Transport Bhawan, 1-Parliament Street, New Delhi-110001, or by email at [email protected] and [email protected] within the period specified above; Draft Amendment 1. (1) These rules may be called as the Inland Vessels (Crew and Passenger Accommodation) (First Amendment) Rules, 2024. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Inland Vessels (Crew and Passenger Accommodation) Rules, 2022 (hereinafter referred to as the said rules), after clause (c) of rule 2, the following explanation shall be inserted, namely. - "Explanation. - For the purpose of this sub-rule, Gross Tonnage of vessels above 24 meters shall be calculated according to International Convention on Tonnage Measurement of Ships, 1969 whereas Gross Tonnage of vessels less than 24 meters shall be calculated according to Rule 2 of the Merchant Shipping (Tonnage Measurement of Ships) Rules, 1991." 3. In sub-rule (1) of rule 20 of the said rules, for the figure “0.60”, the figure "0.36” shall be substituted. 4. In sub-rule (3) of rule 23 of the said rules, the following sub-rule shall be substituted, namely. - "(3) Inland vessels operating on voyages of more than 15 minutes and upto 60 minutes or less need to provide seating for 50 % of passengers, in accordance with the stability requirements given in Inland Vessels (Design and Construction Rules), 2024; Provided that the motions and accelerations in all normal operation would not make standing difficult." 5. In rule 24 of the said rules: i. In sub-rule (1), the following sub-rule shall be substituted, namely. "Suitable clear space shall be allowed for access, assembly, corridor access and escape with a minimum width of 750 millimetres being provided." ii. in sub-rule (4), for the figure “1600”, the figure “1300” shall be substituted; iii. in sub-rule (5), i. for the figure “680”, the figure “650” shall be substituted; ii. for the figure “310”, the figure “230” shall be substituted; iv. in sub-rule (6), for the figure “620”, the figure “480” shall be substituted. 6. In sub-rule (6) of rule 26 of the said rules: i. the words “or individual unit type” shall be omitted; ii. in clause (b), the following proviso shall be inserted, namely. “Provided that an exemption from the above requirement may be given, on a case-to-case basis by the Designated Authority to Category A vessels of less than 300 GT.” 7. In rule 31 of the said rules, in sub-rule (4), for the figure “30”, the figure “60” shall be substituted. [F.
