ORDER
New Delhi, the 2nd November, 2023
S.O. 4773(E). —Whereas the National Commission for Allied and Healthcare Professions Act, 2021 (14 of
2021) (hereinafter referred to as the Act) came into forc e on 25thMay, 2021, in terms of Section 1(2) of the Act .
AND WHEREAS sub -section (1) of section 22 provides that every State Government shall, by notification,
within six months from the date of commencement of this Act, constitute a State Council to be ca lled the State Allied
and Healthcare Council for exercising such powers and discharging such duties as may be laid down under this Act.
AND WHEREAS due to ongoing elections and the difficulty in finding adequate experienced professionals
in the specific ca tegory in Allied and Healthcare professions as per the provisions of the Act by the States/UTs and
also due to the Legislative/statutory formalities/procedures, the State Allied and Healthcare Councils could not be
constituted by State Governments within s tipulated period and because of that difficulties have arisen regarding
compliance with the said provisions of section 22 of the Act.
AND WHEREAS the stipulated period was extended to two year and six months from the date of
commencement of Act by Order vi z., the National Commission for Allied and Healthcare Professions 5th(Removal of
Difficulties) Order, 2023, dated 18.05.2023.
AND WHEREAS, in exercise of the powers conferred by section 69 of the Act, the Central Government
hereby makes the following Orde r, to remove the above said difficulties, namely:
1. Short title and commencement:
(1) This Order may be called the National Commission for Allied and Healthcare Professions 6th(Removal
of Difficulties) Order, 2023 .
(2) It shall come int o force on the date of its publication in the official Gazette.
2. It is hereby clarified that all the State Governments/Union Territories shall, as soon as may be but within three
years from the date of commencement of the National Commission for Al lied and Healthcare Professions Act, 2021,
constitute State Allied and Healthcare Councils.
