Detailed Summary

The Ministry of Road Transport and Highways, through Notification S.O. 2491(E) dated 4th June, 2025, in exercise of powers conferred by Section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, has levied fees on mechanical vehicles. This follows a previous notification, S.O. 1018(E) dated 28th March, 2017, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), which entrusted National Highway-744 (Old NH-208) from Thirumangalam to Rajapalayam (Existing Ch. Km. 163+000 to Km. 231+600) in Tamil Nadu to the National Highways Authority of India. The fee is applicable to the Thirumangalam-Vadugapatti section (design Km. 0+000 to Km. 36+000) and Vadugapatti-Therkuvanganallur Section (design Km. 36+000 to Km. 71+600) of National Highway number 744. Base rates for various vehicle types (Car, Jeep, Van, Light Motor Vehicle: Rs. 0.65; Light Commercial Vehicle, Light Goods Vehicle, Mini Bus: Rs. 1.05; Bus, Truck (Two Axles): Rs. 2.20; Three-axle commercial vehicles: Rs. 2.40; Heavy Construction Machinery, Earth Moving Equipment, Multi Axle Vehicle (four to six axles): Rs. 3.45; Oversized Vehicles (Seven or more axles): Rs. 4.20) are specified per Km for the base year 2007-08. Fees are payable at the Fee Plaza at Km. 40+450 (Design Chainage) of NH-744 at Nathampatti Village, Watrap Taluk, Virudhunagar District, Tamil Nadu. A 100% rate of base fees applies for a net road section of 33.912 Km and for structures over 60m (equivalent length 7.13 Km) by multiplying the actual length (0.713 Km) by an equalization factor of 10. An additional 150% of the base rate is levied for bypasses totaling 36.975 Km, costing Rs. 10 crore or more, including the T. Kunnathur and T. Kallupatti Bypass (9.800 Km, Rs. 147.44 Crore) and Krishnankoil – Srivilliputhur Rajapalayam Bypass (27.175 Km, Rs. 564.85 Crore). A monthly pass for non-commercial vehicles owned by residents within 20 Km of the fee plaza is Rs. 350.00 for 2025-26, subject to annual revision. Multiple journey passes are available: one and a half times the one-way fee for two journeys within 24 hours, and two-thirds of the fifty single journeys amount for fifty journeys within one month. Commercial vehicles registered in the district where the fee plaza falls are charged 50% of the specified rate if no service or alternative road is available. Overloaded vehicles are liable to pay a fee equal to that specified in sub-rule 1A of Rule 10 of the said rules. All definitions are as per the National Highways Fee Rules, 2008, and rates will be displayed as per Rule 12. The Authority will calculate and annually revise fees based on Rule 5 and publish them in English and vernacular newspapers. The estimated capital cost of the project is Rs. 1739.62 Cr., with the Authority maintaining records of capital cost recovery through user fees. This notification is signed by Kamlesh Chaturvedi, Jt. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs.350.00 (Rupees Three Hundred Fifty Only) for the year 2025-26, and is subject to revision every year as per the provisions of the said rules. 5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc., shall be as per definitions specified in the said rules. 9. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said rules. 10. Based on the Base Rate of Fee per km for the base year 2007-08 as mentioned in Table-I above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the sections and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language. 11. The estimated capital cost of the project is Rs. 1739.62 Cr. [The capital cost is subject to variation as the Land Acquisition, Utility Shifting, Tree cutting, etc., are yet to be completed].
