Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade), Order S.O. 3893(E) dated 1 September 2023, issued under section 16 read with section 25(3) of the Bureau of Indian Standards Act, 2016 (11 of 2016), after consulting the Bureau of Indian Standards, amends the Footwear Made from all Rubber and all Polymeric Material and its Components (Quality Control) Order, 2022 by inserting a further proviso in paragraph 2 exempting import of specified components -- moulded solid rubber soles and heels (IS 5676:1995), rubber microcellular sheets for soles and heels (IS 6664:1992), solid PVC soles and heels (IS 6719:1972), and semi-rigid polyurethane sole (IS 13893:1994) -- used in manufacturing footwear in India for export only. The exemption requires a self-declaration by the importer, certified by the Council for Leather Exports, quoting the importer's Registration-cum-Membership Certificate number and date, Udyam Registration Certificate number and date, and Bill of Entry number and date, with supporting documents uploaded to the Indian Customs Electronic Data Interchange portal. Titled the Footwear Made from all Rubber and all Polymeric Material and its Components (Quality Control) Amendment Order, 2023, it takes effect from the date of Gazette publication. L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 3732] NEW DEL HI, MON DAY , SEPTEMBER 4, 2023/ BHADRA 13, 1945 CG-DL-E-05092023-248543 MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal T rade) ORDER New Delhi, the 1st September , 2023 S.O. 3 893(E).—In exerc ise of the powers conferred by section 16 re ad with sub -section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary or e xpedient so to do in the public interest, he reby makes the following order to amend the Footwear Made from all Rubber and all Polymeric Material and its Components (Quality Control) order, 2022, namely: - 1. (1) This Order may be called the Footwear Made fr om all Rubber and all Polymeric Material and its Components (Quality Control) Amendment Order, 2023. (2) It shall come into force from the date of its publication in the official G azette. 2. In the Footwear Made from all Rubber and all Polymeric Mater ial and its Components (Quality Control) Ame ndment Order, 2022, in paragraph 2 after the second proviso, the following proviso shall be inserted namely: - “Provided further that nothing in this Order shall apply, after th e commencement of the Footwear M ade from all Rubber and all Polymeric Material and its components (Quality Control) Amendment Order, 2023, to import of goods or articles specified in the Table below used in manufacturing of footwear in India for export only, namely: - TABLE S. No. Goods or Articles (Components) Indian Standard Title of Indian Standards 3 Moulded solid rubber soles and heels IS 5676:1995 Moulded solid rubber soles and heels – specification 4 Rubber microcellular sheets for soles and heels IS 6664:1992 Rubber microcellular s heets for soles and heels – specification 5 Solid PVC soles and heels IS 6719:1972 Specification for solid PVC soles and heels 10 Polyurethane sole, semi rigid IS 13893:1994 Polyurethane sole, semi rigid – specification Provided also that the importer shall furnish a self declaration certified by the Council for Leather Exports before the import consignments of footwear soles given import clearance at the customs in the following manner, namely: - i. self-declaration by the importer that the footwear soles imported are meant for production or assemb ly of footwear for exports and not for sale in the domestic market of India; ii. the self -declaration will be in the Letter Head of the importer duly mentioning the Invoice Number and other relevant details of the im port consignment and mentioning that the imp orted items shall not be put to any other use o r sold in the domestic market except in the manufacture of footwear for the purpose of exports and the company will maintain its internal records for any future veri fication or audit by concerned authorities; iii. certification by the Council for Leather Expor ts that the importer is a manufacturer exporter registered with the Council by quoting (a) currently valid Registration -cum-Membership Certificate number and date o f issue; (b) Udyam R egistration Certificate Number and date; (c) Bill of Entry for home con sumption number and date which is filed in the Indian Customs Electronic Data Interchange system for import clearance; and iv. the importers must upload the above docum ents along with other relevant documents in the Indian Customs Electronic Data Interchange portal, for smooth customs clearance of the footwear soles.
