The QR Code must contain a Unique Identifier/Global Trade Item Number (GTIN), batch number, manufacturing date, expiry date, and web link. Provisions of the Legal Metrology (Packaged Commodities) Rules, 2011, are applicable for certain items. Clause (iii) of sub-rule (1) is substituted, requiring ultra small or small packages to be in a secondary pack displaying all primary label contents, unless the primary pack already meets these requirements. For ultra-small packs, multiple primary packs can be in one secondary pack, with leaflets and QR codes securely attached to each primary pack. A proviso is inserted into clause (iv), allowing ultra small packs to display abbreviated composition and manufacturer address on the label, with full details on the leaflet. The first proviso of sub-rule (3) is substituted, stipulating that for ultra-small packs, the dimensions of the specified square shall not be less than 1 square centimeter. A new Explanation is added after sub-rule (3), clarifying that registration certificate holders cannot use non-compliant labels or leaflets after six months from the rules' commencement, and non-compliant insecticides/packages cannot be distributed, sold, exhibited, or stocked after thirty months, after which this explanation ceases unless otherwise directed. Finally, the words “unless stated otherwise” are omitted from sub-rule (7). The principal rules were originally published vide G.S.R. 1650 (E) dated October 19, 1971, and last amended vide G.S.R 228(E) dated March 22, 2024. L.-33004/99 The Gazette of India CG-DL-E-05062025-263622 EXTRAORDINARY PART II-Section 3-Sub-section (i) PUBLISHED BY AUTHORITY No. 325] NEW DELHI, WEDNESDAY, JUNE 4, 2025/JYAISTHA 14, 1947 MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 3rd June, 2025 G.S.R. 368(E). - Whereas the draft rules further to amend the Insecticides Rules, 1971, was published, as required by section 36 of the Insecticides Act, 1968 (46 of 1968) vide notification of the Government of India in the Ministry of Agriculture and Farmers Welfare (Department of Agriculture and Farmers Welfare) number G.S.R. 894 (E), dated the 14th December, 2023, in the Gazette of India, Extraordinary, Part-II, Section-3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Gazette of India in which the said notification was published, were made available to the public; And whereas, copies of the said notification were made available to the public on 14th day of December, 2023; And whereas, objections or suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 36 of the said Act, the Central Government hereby makes the following rules further to amend the Insecticides Rules, 1971, namely:- 1. (1) These rules may be called the Insecticides (First Amendment) Rules, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Insecticides Rules, 1971, herein after referred to as the principal rules, in rule 19, in sub-rule (1),- (1) for clause (i), the following clause shall be substituted, namely:- "(i) The label shall have either one, two or three panels and shall be printed only in English and Hindi languages and the minimum size of all the label panels shall be according to the size affixed on the face of the package: Provided that there shall be three types of labels depending on the net content: (I) ultra small package -1gm or ml to 50 gm or ml; (II) small package -51 gm or ml to 250 gm or ml; (III) big package->250 gm or ml and the following information shall be printed such on the label, namely:- (a) name of insecticide (brand name or trade name under which the insecticide is sold) provided that the brand name shall not be of bigger size than 1.5 times size of common name and common name shall be placed below the brand name and it should not occupy more than twenty percent of area of the face of the panel and the brand name shall be in bold; (b) common name as such approved by Registration Committee; (c) instructions to "Read Leaflet Before Use" shall be placed on the top of the label in bold, in a prominent place at least in English and Hindi languages in all package sizes and in addition, for big pack size in all such regional languages where it is proposed for sale; (d) purpose of the chemical shall be mentioned on the label, for example:- (i) for Agricultural Use; (ii) for Pest Control Operators; (iii) for House Hold Use; (iv) for Public Health; and (v) others(specify). (e) optimal re-entry period after each application of insecticide as approved by the Registration Committee; (f) composition of the formulation or insecticides; (g) Please refer leaflet for details of directions for use, manner and time of application, and list of crops or target area and broad category of pests on which it is registered to apply, dosage (include gram active ingredient, formulation and dilution in litres and area), symptoms of poisoning and first aid. (h) safety precautions as approved by Registration Committee (Please refer leaflet for details); (i) antidote statement; (j) name of the manufacturer; (k) imported and re-packed by (wherever applicable); (1) marketed by; (m) registration number of the insecticide; (n) manufacturing license number; (o) batch number; (p) manufacturing date; (৭) expiry date; (r) Maximum Retail Price inclusive of all taxes; (s) net content weight or volume (in metric system); Note I: The provisions of the Legal Metrology (Packaged Commodities) Rules 2011 shall be applicable for items (p), (q) and (r). (t) cautionary statement :- (i) not to be used for any purpose other than those subscribed on label and leaflets; (ii) destroy the container after use as directed on leaflet; and (iii) any other warning or cautionary statement as approved by Registration Committee; and (u) Customer care details such as Company's name, Quick Response(QR) Code, e-mail id and customer care numbers: Provided that Quick Response Code shall be placed on retail pack (Primary or Secondary pack as the case may be) at suitable place where on scanning the Quick Response code by scanning equipment like mobile phone, a web link or link for opening the Uniform Resource Locator(URL) of the Manufacturing company shall appear, which on pressing or clicking, shall take the user to the entire unique information of label and leaflet and the Quick Response code shall contain at least the following information, namely:- (a) Unique Identifier or Global Trade Item Number(GTIN); (b) batch number; (c) date of manufacturing; (d) date of expiry; and (e) web link or Uniform Resource Locator. Note II : A. The provisions of item (u) are in addition to the Legal Metrology(Packaged Commodities) Rules, 2011 B. Additional information may be added to the Label after approval by the Registration Committee. C. All relevant safety pictograms (refer picture I in the THIRD SCHEDULE) of size not less than one square centimetre at the bottom of the label in respect of labels of minimum size. The pictograms shall be proportionately bigger in respect of labels of bigger size on the bottom of the right side panel. They shall be printed only once on the label. For small labels the pictograms on the primary pack shall be printed on primary or the secondary pack and for ultra small labels the pictograms shall be printed on leaflet and the words 'Please refer leaflet for safety pictograms' shall be mentioned on label. (2) for clause (iii), the following clause shall be substituted, namely:- "(a) The ultra small or small packages shall also be packed in a secondary pack whose label shall be printed with indelible ink displaying all contents of clause (i) of sub-rule (1) of rule 19: Provided that the secondary packs may not be required for ultra or small packages whose label of primary pack have all contents of clause (i) of sub-rule (1) of rule 19 with indelible ink in the font sizes not less than size prescribed: Provided further that for ultra-small packs, multiple primary packs may be packed in one secondary pack and the manufacturer shall ensure leaflet and Quick Response code be securely attached with each primary pack before packing them in one secondary pack. (b) The label of the big package shall be printed with indelible ink displaying all contents of clause (i) of sub-rule (1) of rule 19 and the big package may also be packed in a secondary pack." (3) in clause (iv), the following proviso shall be inserted, namely:- "provided that in case of ultra small packs, composition of the formulation or insecticide may be displayed in short as "percentage of active ingredient and other ingredients” and the complete composition shall be printed on leaflet and the name and address of the manufacturer may be printed in short on label and complete address shall be printed on leaflet." 3. In the principal rules, in sub-rule (3), for the first proviso, the following proviso shall be substituted, namely:- "provided that for ultra-small packs, the dimensions of the said square shall be not less than 1 square centimeter (1.0 cm x1.0 cm)." 4. after sub-rule (3), for the Explanation, the following Explanation shall be substituted, namely:- "Explanation.- For the purposes of sub-rule (1) and sub-rule (3), it is hereby clarified that,- (i) no registration certificate holder shall use a label or leaflet, which is not in accordance with the provisions of the Insecticides (First Amendment) Rules, 2025, after a period of six months from the date of commencement of the said Rules. (ii) no insecticides or its package bearing a label or leaflet, which is not in accordance with the provisions of the Insecticides (First Amendment) Rules, 2025, shall be distributed, sold, exhibited for sale or stocked, after a period of thirty months from the date of commencement of the said rules and this explanation shall cease to exist after expiry of the said period, unless otherwise directed." 5.
