Detailed Summary

By notification S.O. 2201(E) dated 4th June 2024, the Ministry of Road Transport and Highways recalled that the stretch from Km. 6.000 to Km. 171.00 of the Indore-Gujarat/Madhya Pradesh border section of National Highway No. 47 (Old NH 59) in Madhya Pradesh had been entrusted to the National Highways Authority of India by notification S.O. 910(E) dated 21-04-2010 under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), and that M/s IVRCL Indore Gujarat Tollways Ltd. (registered office M-22/3RT, Vijaya Nagar Colony, Hyderabad-500057), the Concessionaire, had been authorized by notification S.O. 2168(E) dated 16-07-2013 to collect and retain fee; the Authority had subsequently descoped a 16.09 km length (covering a Bird Sanctuary stretch, Machaliya Ghat section and forest portions) and developed it separately through an EPC contractor. Now, in exercise of powers under Section 7 of the National Highways Act, 1956 (48 of 1956) read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the Central Government levies fee at 100% of the base rate for a net road length of 15.28 km plus an equivalent 8.1 km for structures exceeding 60m (actual structure length 0.81 km, comprising four viaducts), collectible at the toll plaza at Km. 118.650 near village Dattigaon Junapani, Dhar district, per a supplementary agreement dated 18.11.2023 between the Authority and the Concessionaire. Base-year (2007-08) per-km rates are specified for vehicle categories: cars/jeeps/vans/LMVs Rs. 0.65, light commercial/goods vehicles/mini buses Rs. 1.05, two-axle buses/trucks Rs. 2.20, three-axle commercial vehicles Rs. 2.40, heavy construction machinery/multi-axle vehicles (4-6 axles) Rs. 3.45, and oversized vehicles (7+ axles) Rs. 4.20. A monthly local-resident pass (within 20 km) is set at Rs. 340 for 2024-25; multiple-journey passes are priced at 1.5 times the one-way fee for two journeys valid 24 hours, or two-thirds of the fifty-journey fee valid one month. Local commercial vehicles receive a 50% fee discount where no service/alternative road exists, overloaded vehicles incur additional fee under Rule 10(1A), and fee rates must be displayed per Rule 12. The estimated capital cost of the project is Rs. 281.757 crore, subject to revision. The notification (F. Whereas, later on Authority descoped 16.09 KM length (from Km. 106.210 to 115.250 (Start and end point of Bird Sanctuary), Km. 121.740 to Km. 127.140 (Machaliya Ghat Section) and Forest portion km. 149.800 to km. 150.850, km. 158.250 to km. 158.850) from the scope of the BOT concessionaire and developed this 16.09 Km length at its own cost through an EPC contractor. Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the "rules"), the Central Government hereby levies the fee at 100% of the base rate specified in column (2) in Table 1 for net road section length of 15.28 km and for equivalent length of 8.1 km for structure having length more than 60m (having length of 0.81 Km) on type of vehicle specified in column (1) of table 1 below of balance portion at Bird Sanctuary/Machliya Ghat area of Indore-Gujarat/Madhya Pradesh border section of National Highway No. 47 (Old NH 59) in the State of Madhya Pradesh and authorises Authority to collect, either through its officials or through a contractor or through existing toll infrastructure at Km. 118.650 near village Dattigaon Junapani in Dist. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty Kilometers from the fee plaza is Rs.340.000 (Three Hundred Fourty Rupees) for the year 2024-25 and is subject to revision every year as per the provisions of the said rules. 4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 6. The driver or owner or a person in charge of a which mechanical vehicle is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 8. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 9. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 10. The estimated capital cost of the project is Rs. 281.757 Cr. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed and the final capital cost will be notified separately.
