The Ministry of Health and Family Welfare (Department of Health and Family Welfare) published draft rules dated 29th May 2024 under G.S.R. 310(E), issued in exercise of powers under section 91 of the Food Safety and Standards Act, 2006 (34 of 2006), proposing further amendment to the Food Safety and Standards Rules, 2011. The draft, to be called the Food Safety and Standards (First Amendment) Rules, 2024, would come into force on the date of publication in the Official Gazette and substitutes clause (5) of sub-rule 3.1.1 (relating to 'Holding of inquiry') of rule 3.1 to empower the Adjudicating Officer to hold an inquiry for adjudicating offences punishable under sections 50, 51, 52, 53, 54, 55, 56, 57, 58, 61, 63, 64, 65, 66 and 67 of the Act; objections and suggestions on the draft may be sent within thirty days to Shri Vishal Kumar Gupta, Under Secretary, Ministry of Health and Family Welfare, Nirman Bhawan, New Delhi, or via email to [email protected], and the notification records that the principal rules were published vide G.S.R. 362(E) dated 5th May 2011 and last amended vide G.S.R. 33(E) dated 16th January 2023, with the notification signed by Rajiv Wadhawan, Advisor (Cost), under F. No. P.15014/13/2019-FR.

L.-33004/99 The Gazette of India CG-DL-E-05062024-254556 EXTRAORDINARY PART II—Section 3—Sub-section (i) PUBLISHED BY AUTHORITY No.289] NEW DELHI, WEDNESDAY, JUNE 5, 2024/JYAISHTHA 15, 1946 MINISTRY OF HEALTH AND FAMILY WELFARE (Department of Health and Family Welfare) NOTIFICATION New Delhi, the 29th May, 2024 G.S.R. 310(E).—The following draft of certain rules further to amend the Food Safety and Standards Rules, 2011, which the Central Government, proposes to make, in exercise of powers conferred by section 91 of the Food Safety and Standards Act, 2006, (34 of 2006) is hereby published for the information of persons likely to be affected thereby and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of thirty days from the date on which copies of the Official Gazette in which this notification is published are made available to the public; Objections and suggestions, if any, may be addressed to Shri Vishal Kumar Gupta, Under Secretary, Ministry of Health and Family Welfare, Room No.514-A Wing, Nirman Bhawan, New Delhi-110011, or may be sent through e-mail at [email protected] The objections or suggestions which may be received from any person with respect to said draft rules, before the expiry of the period so specified above, will be considered by the Central Government. Draft Rules 1. (1) These rules may be called the Food Safety and Standards (First Amendment) Rules, 2024. (2) They shall come into the force on the date of their publication in the Official Gazette. 2. In the Food Safety and Standards Rules, 2011, in rule 3.1, in sub-rule 3.1.1 relating to ‘Holding of inquiry', for clause (5), the following clause shall be substituted, namely: "5. The Adjudicating Officer shall have power to hold an inquiry for purpose of adjudicating offences punishable under sections 50, 51, 52, 53, 54, 55, 56, 57, 58, 61, 63, 64, 65, 66 and 67 of the Act."
