Detailed Summary

The Ministry of Road Transport and Highways, through notification G.S.R. 153(E) dated 2nd March, 2026, has enacted the Compensation to Victims of Hit and Run Motor Accidents (Amendment) Scheme, 2026. This scheme, made in exercise of powers conferred by section 161 and sub-section (4) of section 215 of the Motor Vehicles Act, 1988 (59 of 1988), amends the Compensation to Victims of Hit and Run Motor Accidents Scheme, 2022. The draft scheme was previously published as G.S.R 755(E) dated 14th October, 2025, inviting objections and suggestions, which were considered by the Central Government. Key amendments include renumbering and omitting certain clauses in paragraph 2, substituting the definition of 'District Road Safety Committee' (under section 215(3) of the Act), and inserting new definitions for 'Fund' (Motor Vehicle Accident Fund, as per Central Motor Vehicles (Motor Vehicle Accident Fund) Rules, 2022, rule 2(b)), 'GI Council' (General Insurance Council, under section 64C of the Insurance Act, 1938), and 'portal' (web-based system by GI Council). The scheme also introduces 'State Road Safety Council' (under section 215(2) of the Act). Throughout the principal scheme, references to "General Insurance" are largely replaced with "GI", and "Director" is replaced with "an officer not below the rank of Deputy Secretary" in paragraph 3(c). Paragraphs 11, 12, 14, 15, 16, 17, and 18 are omitted. New paragraphs 13 and 13A are substituted, detailing the powers and functions of the District Road Safety Committee and the State Road Safety Council, respectively. Procedures for application submission (Form I), claim enquiry report (Form II), and sanction orders (Form III) are revised, including the use of an electronic portal. The Claims Settlement Commissioner is now required to sanction claims within fifteen days of receiving the Claims Enquiry Officer's report and communicate the order via Form III to the GI Council for payment from the Hit and Run Compensation Account of the Fund, administered by the Trust constituted under rule 4 of the Central Motor Vehicles (Motor Vehicle Accident Fund) Rules, 2022. The amendment also clarifies provisions for payments to legal representatives in cases of death unrelated to the accident and allows the GI Council to seek further information from claimants for payment processing. The principal rules were published vide G.S.R. 163(E) dated 25th February.

L.-33004/99 The Gazette of India CG-DL-E-05032026-270658 EXTRAORDINARY PART II-Section 3-Sub-section (i) PUBLISHED BY AUTHORITY No. 147] NEW DELHI, MONDAY, MARCH 2, 2026/PHALGUNA 11, 1947 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 2nd March, 2026 G.S.R. 153(E).—Whereas, the draft Scheme to amend the Compensation to Victims of Hit and Run Motor Accidents Scheme, 2022, were published, as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways, vide number G.S.R 755(E), dated the 14th October, 2025, in the Gazette of India, Extraordinary, Part II, Section 3, Sub- section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to public; And, whereas, copies of the said Gazette notification, was made available to the public on 16th October, 2025; And, whereas, the objections and suggestions received from the public in respect of the said draft Scheme have been considered by Central Government; Now, therefore, in exercise of the powers conferred by section 161 and sub-section (4) of section 215 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following Scheme, to amend the Compensation to Victims of Hit and Run Motor Accidents Scheme, 2022, namely:- 1. Short title and commencement. - (1) This Scheme may be called as the Compensation to Victims of Hit and Run Motor Accidents (Amendment) Scheme, 2026. (2) It shall come into force on the date of its publication in the Official Gazette. 2. In the Compensation to Victims of Hit and Run Motor Accidents Scheme, 2022 (hereinafter referred to as the said Scheme), in paragraph 2,- (a) the paragraph 2 shall be renumbered as sub-paragraph (1); (b) clauses (b), (c) and (d) of sub-paragraph (1) as so renumbered shall be omitted; (c) for clause (g) of sub-paragraph (1) as so renumbered, the following clause shall be substituted, namely:— '(g) "District Road Safety Committee" means a Committee set up under sub-section (3) of section 215 of the Act;'; (d) after clause (h) of sub-paragraph (1) as so renumbered, the following clauses shall be inserted, namely:- '(ha) "Fund" means the Motor Vehicle Accident Fund as defined in sub-rule (b) of rule 2 of the Central Motor Vehicles (Motor Vehicle Accident Fund) Rules, 2022; '(hb) "GI Council" means the General Insurance Council constituted under section 64C of the Insurance Act, 1938 (4 of 1938);' (e) clauses (j) of sub-paragraph (1) as so renumbered shall be omitted; (f) after clause (j) of sub-paragraph (1) as so renumbered, the following clause shall be inserted, namely: '(ja) "portal" means a web or electronic based system developed and managed by the General Insurance Council for the purpose of this scheme;'; (g) after clause (1) of sub-paragraph (1) as so renumbered, the following clause shall be inserted, namely, '(m) "State Road Safety Council" means the Council for a State or Union territory, as the case may be, constituted under sub-section (2) of section 215 of the Act.'; (h) After clause (1) as so renumbered, following clause shall be inserted, namely, "(2) Words and expressions used in this Scheme but not defined herein, and defined in the Act, shall have the same meanings respectively assigned to them in the Act." 3. In the said Scheme, in paragraph 3, in sub-paragraph (1), (a) in clause (d), for the word “General Insurance", the word "GI" shall be substituted; (b) in clause (i), for the word "General Insurance", the word "GI" shall be substituted; (c) in clause (h), for the word "Director", the words "an officer not below the rank of Deputy Secretary" shall be substituted. 4. In the said Scheme, in paragraph 5, (a) in clause (a), for the words "General Insurance", the word “GI” shall be substituted; (b) for clause (b), the following clause shall be substituted, namely, "(b) consider the issues raised by the authority specified under paragraph 13A and provide guidance or directions to concerned officials responsible for implementation of the scheme, including on prevention of fraud, wherever called for;"; (c) clause (d) shall be omitted; (d) after clause (d), the following clause shall be inserted, namely: "(e) having regards to the circumstances of the case, if deemed appropriate, make recommendations to the Central Government or State Government for taking appropriate action under clause (b) of sub-section (4) of section 161 of the Act for contravention of provisions of this scheme.". 5. In the said Scheme, paragraphs 11 and 12 shall be omitted. 6. In the said Scheme, for paragraph 13, the following paragraphs shall be substituted, namely: "13. Powers and functions of the District Road Safety Committee.—(1) The District Road Safety Committee shall undertake following functions connected with the implementation of this scheme at the District Level, namely: (a) evaluate the implementation of this scheme in the concerned District and take corrective steps, wherever necessary; (b) maintain month-wise statistics, including in electronic form, about the claim applications received, awarded or pending and reasons for pendency in the concerned District; (c) keep close liaison with other authorities in the district so as to ensure that this scheme gets adequate publicity; (d) provide guidance to claimants, wherever called for; (e) raise awareness about the rights available to claimants and the provision of compensation under this scheme; and (f) furnish information in respect of this scheme to the agency or authority specified under paragraph 13A. (2) The concerned Claims Enquiry Officer and the officer nominated under paragraph 19 of this scheme may be invited in the meetings of the District Road Safety Committee whenever the functions provided in sub-paragraph (1) are undertaken. 13A. Powers and Functions of the State Road Safety Council.- (1) The State Road Safety Council or authority as may be designated by the State Government may undertake following functions connected with the implementation of this scheme in the concerned State or Union territory, as the case may be, namely, (a) evaluate the progress of implementation of this scheme and take corrective steps, wherever necessary; (b) review month-wise statistics, including in electronic form, about the claim applications received, awarded, pending and reasons for pendency; (c) issue directions to concerned district authorities for improving the implementation of this scheme; (d) furnish information or raise implementation related issue to the Central Government or Standing Committee in respect of this scheme.". 7. In the said Scheme, paragraphs 14, 15, 16, 17 and 18 shall be omitted. 8. In the said Scheme, in paragraph 19, for the words "General Insurance", the word "GI" shall be substituted. 9. In the said Scheme, in paragraph 20, for sub-paragraph (1), the following sub-paragraph shall be substituted, namely: "(1) The applicant shall submit an application seeking compensation under this scheme in Form I, along with an undertaking in Form IV, and such other documents mentioned in Form I, including through electronic means, to the Claims Enquiry Officer of the Sub-Division or Taluka in which the accident took place.". 10. In the said Scheme, in paragraph 21, (a) in sub-paragraph (2), in clause (b), after the words "Claims Settlement Commissioner", the words "on the portal" shall be inserted; (b) in sub-paragraph (3), after the words "report to the Claims Enquiry Officer", the words "on the portal" shall be inserted. 11. In the said Scheme, in paragraph 22, (a) for sub-paragraph (1), the following sub-paragraph shall be substituted, namely: "(1) On receipt of report of the Claims Enquiry Officer, the Claims Settlement Commissioner shall sanction the claim, as far as possible, within a period not exceeding fifteen days from the date of receipt of such report and communicate the sanction order in Form III, to the GI Council, including through the portal, for payment from the Hit and Run Compensation Account of the Fund administered by the Trust constituted under rule 4 of the Central Motor Vehicles (Motor Vehicle Accident Fund) Rules, 2022, with a copy to the following: (a) the Claims Enquiry Officer; (b) the claimant; (c) the concerned Motor Accident Claim Tribunal; (d) the concerned Transport Commissioner; (e) Member-Secretary, District Road Safety Committee.". (b) sub-paragraph (2) and the provisos thereto shall be omitted. 12. In the said Scheme, in paragraph 23, (a) in sub-paragraph (2), after the words "person injured", the words "or to the legal representatives of the deceased decided by the Claims Enquiry Officer in case such person dies due to causes unrelated to the accident, as the case may be" shall inserted. (b) in sub-paragraph (3), (i) for the words and brackets “General Insurance Council (GIC)", the words “GI Council” shall be substituted; (ii) words "and the Forms and documents from claimant," shall be omitted. (iii) in sub-paragraph (4), after the proviso, following proviso shall be inserted, namely, "Provided further that in case of any deficiency in the particulars furnished by the claimant necessary for making the payment under sub-paragraph (3), including but not limited to bank account details, the GI Council, in coordination with the concerned Claim Settlement Commissioner, may, within the period specified in this sub-paragraph, seek the necessary information from the claimant." 13. In the said Scheme, in paragraph 24, for the words "General Insurance", the word "GI" shall be substituted. 14. In the said Scheme, for "Form I", the following Form shall be substituted, namely: "FORM I [Paragraph 20 (1)] COMPENSATION TO VICTIMS OF HIT AND RUN MOTOR ACCIDENTS SCHEME, 2022 Application Form For grievous hurt case:* I, ............................................son / daughter / spouse of ........................... residing at ............................................ having been grievously injured in hit and run motor vehicle accident on ................................ at ................................hereby apply for grant of compensation for the grievous injuries sustained from the Central Government's Motor Vehicle Accident Fund. Necessary particulars in respect of the injury sustained by me are given below:- For grievous hurt case (through legal representative):* I, ............................................ son / daughter / spouse of ........................... residing at ............................................ as a legal representative of ............................................ son / daughter / spouse of............................................ who sustained grievous injuries in hit and run motor vehicle accident on ................................ at ............................................and died due to cause unrelated to the accident, hereby apply for grant of compensation from the Central Government's Motor Vehicle Accident Fund.
