NOTIFICATION
New Delhi, the 27th June, 2025
G.S.R. 440(E).— In exercise of the powers conferred by section 96 of the Protection of Plant
Varieties and Farmers' Rights Act, 2001 (53 of 2001) read with section 22 of the General Clauses Act, 1897
(10 of 1897), the Central Government hereby makes the following rules further to amend the Protection of
Plant Varieties and Farmers' Rights Rules, 2003 namely:-
1. Short title and commencement.- (1) These Rules may be called the Protection of
Plant Varieties and Farmers' Rights (Amendment) Rules, 2025.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Protection of Plant Varieties and Farmers' Rights Rules, 2003 (hereinafter referred to as the
principal rules), for rule 20, the following rules shall be substituted, namely:-
"20. The method of appointment of officers and other employees of the Authority.- (1) The Authority
shall recruit and make appointments to the posts of officers specified in the Fourth Schedule annexed to these
rules.
(2) The number of posts, their classification and their pay level attached thereto shall be as per the
service conditions specified in the Seventh Schedule annexed to these rules.
20A. Initial Constitution.- (1) Personnel holding the posts specified in Column (1) of
the Seventh Schedule, immediately before the commencement of these rules on a regular basis shall be
deemed to have been appointed under the provisions of these rules.
(2) The regular continuous service of personnel referred in sub-rule (1) in the respective grade
immediately before the commencement of these rules shall count for the purpose of the probation period,
qualifying service for promotion, confirmation and pension in the service.".
3. In the principal rules, for the Fourth Schedule the following Schedule shall be substituted, namely: -
