A. BACKGROUND OF THE CASE F. No. 06/16/2022-DGTR.— Having regard to the Customs Tariff Act, 1975, as amended from time to time (hereinafter also referred to as the “Act”), and the Customs Tariff (Identification, Assessment and Collection of Anti- Dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, as amended from time to time, (hereinafter also referred to as the “Rules” or “AD Rules”) thereof: 1. The Indian Printed Circuit Association (hereinafter also referred to as the “applicant association” or “IPCA”) has filed an application before the Designated Authority (hereinafter also referred to as the “Authority”) in accordance with the Act for the imposition of anti-dumping duty on imports of Printed Circuit Boards (PCB) (hereinafter also referred to as the “subject goods” or the “product under consideration” or the “the PUC”) from China PR and Hong Kong (hereinafter also referred to as the “subject countries”). The six domestic producers, namely, Ascent Circuits Pvt. Ltd.; Indian Circuits Pvt. Ltd.; BPL Limited; Multiline Electronics Pvt. Ltd.; Sigma Technologies and Electronics India (hereinafter also collectively referred to as the “domestic industry” or “applicants” or “petitioners”) have provided the relevant information for the injury analysis. 2. Whereas the Authority, on the basis of sufficient prima facie evidence submitted by the pplicant, issued a public notice vide Notification No. 6/16/2022-DGAD dated 30.12.2022, published in the Gazette of India Extraordinary, initiating the subject investigation in accordance with Rule 5 of the Rules to determine the existence, degree and effect of the alleged dumping of the subject goods, originating in or exported from the subject countries, and to recommend the amount of anti-dumping duty, which if levied, would be adequate to remove the alleged injury to the domestic industry. B. PROCEDURE 3. The procedure described herein below has been followed by the Authority with regard to the subject investigation: i. The Authority, under the above Rules, received a written application from the applicant association on behalf of its members who are involved in manufacturing of PCB, alleging dumping of Printed Circuit Boards (PCBs) from the subject countries. ii. The Authority notified the embassies of the subject countries in India about the receipt of the anti- dumping application before proceeding to initiate the investigation in accordance with Sub-Rule (5) of the Rule 5. iii. The Authority issued a public notice dated 30th December 2022 published in the Gazette of India Extraordinary, initiating an anti-dumping investigation concerning imports of the subject goods from the subject countries. iv. The Authority sent a copy of the initiation notification and a copy of the non-confidential version of the application to the embassies of the subject countries in India, known producers/ exporters from the subject countries, known importers/ users and the domestic industry as well as the other domestic producers as per the addresses made available by the applicant association and requested them to make their views known in writing within the prescribed time limit. v. The embassies of the subject countries in India were also requested to advise the exporters/ producers from their countries to respond to the questionnaire within the prescribed time limit. vi.
