The Department of Health and Family Welfare, Ministry of Health and Family Welfare, issued Notification G.S.R. 742(E), dated 2nd December 2024, making the "Cigarettes and other Tobacco Products (Packaging and Labelling) Amendment Rules, 2024" under sections 7(1), 8, 9(2), 10 and 31 of the Cigarettes and other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003 (34 of 2003), amending the Cigarettes and other Tobacco Products (Packaging and Labelling) Rules, 2008; effective 1st June 2025, the amendment inserts sub-rule (3A) in rule 5 continuing existing health warnings until the Schedule warnings are amended, and replaces the specified textual health warning in the Schedule with "TOBACCO CAUSES PAINFUL DEATH" in white font on a red background and "QUIT TODAY CALL 1800-11-2356" in white font on a black background, with prescribed CMYK colour values and a minimum printing resolution of 300 DPI, to be printed as two rotating images (Image-1 and Image-2), each valid for twelve months from commencement, with fonts and colours as uploaded on www.mohfw.gov.in and https://ntcp.mohfw.gov.in; the principal rules were published vide G.S.R. 182(E) dated 15th March 2008 and last amended vide G.S.R. 592(E) dated 21st July 2022; the notification was signed by Nikhil Gajraj, Joint Secretary, under F. In exercise of the powers conferred by sub-section (1) of section 7, section 8, sub-section (2) of section 9, section 10 and section 31 of the Cigarettes and other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003 (34 of 2003), the Central Government hereby makes the following rules further to amend the Cigarettes and other Tobacco Products (Packaging and Labelling) Rules, 2008, namely: - 1. (1) These rules may be called the Cigarettes and other Tobacco Products (Packaging and Labelling) Amendment Rules, 2024. (2) They shall come into force from the date of their publication in the official gazette. 2. In the Cigarettes and other Tobacco Products (Packaging and Labelling) Rules, 2008 (hereinafter referred to as the said rules), in rule 5, after sub-rule (3), the following sub-rule shall be inserted, namely:- "(3A) Notwithstanding anything contained in sub-rules (1), (2) and (3), the specified health warnings for the second twelve months shall remain in force till the specified health warnings provided in paragraphs 1 and 2 of the Schedule are not amended. “ 3. In the said rules, in the Schedule, with effect from the 1st day of June, 2025,- (i) in paragraph (1), for clause (i), the following clause shall be substituted, namely: - "(i) Textual Health Warning. For smoking and smokeless forms of tobacco products, the words 'TOBACCO CAUSES PAINFUL DEATH' shall appear in white font colour on a red background. The words and figures 'QUIT TODAY CALL 1800-11-2356' shall appear in white font colour on a black background. The intensity of color in the background of the textual health warning shall be: White: C:0%, M:0%, Y:0% K:0%, Red: C:0%, M:100%, Y:100% K: 0% and Black: C:0%, M:0%, Y:0% K: 100%. The textual health warnings shall be printed with four colours with printing resolution of minimum 300 DPI (Dots per inch). The font type and colour of the health warning shall be exactly as uploaded on the website www.mohfw.gov.in or https://ntcp.mohfw.gov.in/" (ii) For paragraph 2, the following paragraph shall be substituted, namely: - "2. The specified health warnings shall be- (a) Image-1 which shall be valid for a period of twelve months following its commencement. Image- 1 TOBACCO CAUSES PAINFUL DEATH QUIT TODAY CALL 1800-11-2356 (b) Image-2 which shall come into effect following the end of twelve months from the date of commencement of specified health warning of Image-1.
