L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( i) PUBLISHED BY AUTHORITY No. 554] NEW DELHI, WEDNESDAY , SEPTEMBER 27, 2023/ ASVINA 5, 1945 CG-DL-E-03102023-249044 ………………………………………. ………………………………………. ………………………………………. तारीख….............................. संिभग संख्या...................................................कायागलय ……………………….................... ........ …………. ......................................... संिभग संख्या................................................. .कायागलय…………………………………………। ” MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOT IFICATION New Delhi, the 2 7th September , 2023 G.S.R. 698(E).—Whereas the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub -section (1) of section 212 of the Motor Vehicles Act,1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R 464 (E), dated the 28th June 2023 in the Gazette of India, Extraordinary, Part -II, Section 3, Sub -section (i), inviting objections and suggestio ns from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said notification were made available to the public; And whereas copies of the said Gazett e notification were made available to the public on the 28th June, 2023; And whereas objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government; Now, therefore, in ex ercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: - 1. (1) These rules m ay be called the Cen tral Motor Vehicles (Sixth Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2 In the Central Motor Vehicles Rules, 1989 (hereinafter referred as the said rules), after rule 126D, the follo wing rule shall be inserted, namely: - “126E. Bharat new car assessment programme. - (1)The car assessment programme under this rule shall be applicable on the type approved vehicles of category M1, manufactured or imported in the co untry on or after t he 1st day of October, 2023. (2) On and from the 1st day of October 2023, the manufacturer or importer of motor vehicles shall submit an application in FORM 70A, to the designated agency, designated by the Central Government to get thei r motor vehicle exa mined and assessed for star rating in accordance with AIS:197. (3) The cost of the motor vehicle for the purpose of assessment for star rating and the cost of such assessment shall be borne by the respective manufacturer or importer. (4) The motor vehicle s for the purpose of assessment shall be randomly selected by the designated agency, from the premises of the manufacturer, importer, or authorised dealer of the manufacturer or importer, in accordance with AIS - 197. (5) The designated ag ency shall select a ny of the testing agency, referred to in rule 126, for the assessment of the vehicles selected in sub -rule (2). (6) The manufacturer or importer shall send the selected vehicles to the testing agency selected under sub -rule(4). (7) The testing agency sha ll evaluate the vehicles in accordance with AIS -197 and submit the assessment report to the designated agency in FORM 70B. (8) On examination and approval of the assessment report, the star rating of the vehicle shall be uploaded on the designated portal b y the designated agency: (9) N othing in this rule shall apply to a vehicle exempted under rule 126.”. 3.
