The Ministry of Road Transport and Highways, by Notification S.O. 2004(E) dated 2nd May, 2025, acting under powers conferred by Section 7 of the National Highway Act, 1956 (48 of 1956), read with Rule 3 of the National Highway Fee (Determination of Rates and Collection) Rule, 2008, has levied a fee on mechanical vehicles for using the Ujjain-Badnawar section (Design Ch. 26.900 to Ch. 96.000) of National Highway No. 752D in Madhya Pradesh. This section is part of the highway entrusted to the National Highways Authority of India by Notification S.O. 2919 (E), dated 28.06.2022, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), covering 272.32 km in Madhya Pradesh and 8.3 km in Rajasthan. The fee rates are specified per kilometer based on vehicle type (Table 1, using base year 2007-08 rates) and applied to a net road section length of 40.29 km (four or more lane at 100%, 0.37 km two lane with paved shoulder at 60%) payable at the Fee Plaza at Design Ch. 64+850 (NH-752D Spur Ch. 41+098), Village-Kharsodkhurd, District-Ujjain, Madhya Pradesh. Additional fees are levied for the use of bypasses costing Rs 10 crore or more (Ujjain Bypass - 13.413 km, Rs 158.27 Cr; Badnagar Bypass - 8.844 km, Rs 104.80 Cr; Badnawar Bypass Four lane - 3.080 km, Rs 50.32 Cr; Badnawar Bypass Two lane - 2.45 km; total 27.787 km* total cost Rs 313.39 Cr), charged at 150% of base rates for four or more lane and 90% for two lane with paved shoulders (Table 3). Fee is also payable for structures exceeding 60m length (0.653 km actual length converted to 6.53 km equivalent road length) at 100% of base rate (Table 4), including specific major bridges and ROBs. A monthly pass for non-commercial vehicles within 20 km of the fee plaza is Rs. 340.00 for 2024-25, subject to annual revision per rules. Multiple journey passes are available (2 journeys in 24 hours at 1.5x one-way fee; 50 journeys in one month at two-third of the fee for 50 single journeys). Commercial vehicles registered in the district where the fee plaza falls are charged 50% of the specified rate if no alternative road is available. Overloaded vehicles are liable to pay a fee equal to that specified in sub-rule 1A of the rules before using the highway. Definitions are as per the Rules (Rule 8 mentions 11 definitions), and fee rates shall be displayed per Rule 12. The fee rates will be calculated by the Authority based on the completed section length and revised annually in accordance with Rule 5, published in English and vernacular newspapers. The estimated capital cost of the project is Rupees 1352.56 crore, with the Authority maintaining a record of capital cost recovery through user fees. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance to twenty kilometers from the fee plaza is Rs.340.00 (Rupees Three Hundred and Forty Only) for the year 2024-25 and is subject to revision every year as per the provision of the said rules. 5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. 11 definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules. 9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules. 10. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 11. The estimated capital cost of the project is Rupees 1352.56 crore. The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed). The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost. [F.
