Publication of notification in the Extraordinary Gazette of India under Section 6(1) of the PMP Act 1962 (50 of 1962) relating to land schedule in respect of Kandla Gorakhpur LPG Pipeline to be laid by IHB Limited for acquisition of ROU in the State of Gujarat

No. 3412 (E) dated 28 September, 2020, published in the Gazette of the India No-3042 dated 30 September, 2020 and erratum S. O. No. 1764(E), dated 31 March, 2023, published in the Gazette of the India No-1684 dated 18 April, 2023, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act) the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying “Kandla-Gorakhpur Pipeline Project" for the transportation of LPG in Taluka: Savli of Vadodara District in the state of Gujarat by IHB Limited. And whereas copies of the said Gazette notification were made available to the public up to 12 May, 2023. And whereas Shri Avalabhai Khatarabhai Baria, Competent Authority and Deputy Collector (Retd.), Kandla Gorakhpur LPG Pipeline Project, IHB Limited, Gujarat has under sub-section (1) of section 6 of the said Act submitted report to the Central Government; And whereas the central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline; And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vests on the date publication of this declaration, in IHB Limited, free from all encumbrances. IHB limited shall be exclusively liable for any compensation in terms of Section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
