The Central Government hereby amends the Biological Diversity Rules, 2004, by inserting a new clause (x) into rule 11 to prescribe the manner of accessing and benefit sharing from Digital Sequence Information.

Detailed Summary

This notification, S.O. 2225(E), issued by the Ministry of Environment, Forest and Climate Change on May 20th, 2024, introduces the Biological Diversity (Amendment) Rules, 2024. These rules, made under the powers conferred by section 63 of the Biological Diversity Act, 2002 (18 of 2003), amend the Biological Diversity Rules, 2004. Specifically, a new clause (x) is inserted after clause (w) in rule 11 of the 2004 Rules. This new clause specifies "the manner of accessing and benefit sharing from Digital Sequence Information, its collection, utilization and storage." An explanation clarifies that "Digital Sequence Information" refers to information on genetic sequences of all biological resources generated from research and development, including through new technologies. These amendment rules came into force on their publication date in the Official Gazette. The principal rules were originally published as G.S.R. 96(E) on February 15th, 2004, and were last amended by G.S.R. 44(E) on January 19th, 2024.
