L.-33004/99 The Gazette of India CG-DL-E-29042025-262757 EXTRAORDINARY PART III—Section 4 PUBLISHED BY AUTHORITY No. 321] NEW DELHI, MONDAY, APRIL 28, 2025/ VAISAKHA 8, 1947 EMPLOYEES' PROVIDENT FUND ORGANISATION NOTIFICATION New Delhi, the 25th April, 2025 No. HRD-I/1/2024/EPF-Regulations, 2024.—In exercise of the powers conferred by sub-section (7) of section 5D of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952) and in supersession of the Employees' Provident Fund (Officers and Employees' Conditions of Services) Regulations, 2008, except as respects things done or omitted to be done before such supersession, the Central Board, hereby makes the following regulations, namely:- 1. Short title and commencement.—(1) These regulations may be called the Employees' Provident Fund (Staff and Conditions of Service) Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions- In these regulations, unless the context otherwise requires,- (a) "Act" means the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952); (b) "Central Board" means the Central Board constituted under section 5A of the Act; (c) “Chairman, Central Board" means the Chairman of the Central Board appointed by the Central Government under clause (a) of sub-section (1) of section 5A of the Act; (d) “Chairman, Executive Committee” means the Chairman appointed under clause (a) of sub section (2) of section 5AA of the Act; (e) "Commissioner” includes the Central Provident Fund Commissioner appointed under sub-section (1) of section 5D of the Act and Additional Central Provident Fund Commissioner, Deputy Provident Fund Commissioner, Regional Provident Fund Commissioner and Assistant Provident Fund Commissioner appointed under sub-section (3) of section 5D of the Act; (f) "CPFC" means the Central Provident Fund Commissioner as appointed under sub-section (1) of section 5D of the Act; (g) "employee" means a person appointed to or borne on the cadre of the staff of the Central Board; (h) "Executive Committee" means the Executive Committee constituted under section 5AA of the Act; (i) "month" means a calendar month; (j) "post" means a post under the Central Board, specified in column (2) of the First Schedule annexed to these regulations; the conditions of service of which, except the method of recruitment, shall be such as specified in these regulations; (k) "Schedule" means a Schedule annexed to these regulations; (1) "Service" means service under the Central Board. (2) Words and expressions used herein, but not defined and defined in the Act, shall have the same meaning assigned to them in the Act, or the relevant rules applicable to the officers and employees of the Central Government drawing corresponding scales of pay. 3. Application.— (1) These regulations shall apply to every employee of the Central Board in respect of the posts specified in the First Schedule. (2) In the case of persons appointed by the Central Board on deputation basis from the lending authorities, namely, the Central Government or the State Government or Union territory Administration or local bodies or autonomous bodies including the Universities and the Central and the State Public Sector undertakings, the terms and conditions of appointment shall be settled by the respective appointing authority specified in the Second Schedule, in consultation with the lending authority. (3) These regulations shall not be applicable to the persons appointed on contract or tenure basis. 4. Appointing authority.- The appointing authority in respect of the posts specified in column (2) of the First Schedule, shall be as specified in column (4) of the Second Schedule: Provided that the Chairman, Central Board may, by general or special order, delegate, to any other authority or officer of the Central Board, to make appointment to any post or class of posts specified in the First Schedule. 5. Oath of allegiance to the Constitution of India.—Every employee shall be required to take an oath or solemnly affirm his allegiance to the Constitution of India, as by law established, at the time of his appointment to the service of the Central Board. 6. Declaration to be made by Employees.—Every employee, to whom these regulations apply, shall make the following declaration, namely:- "I hereby declare that I have read and understood the Employees Provident Fund (Staff and Conditions of Service) Regulations, 2025, and I hereby subscribe and agree to be bound by the said regulations. Probation.- (1) Every employee appointed to a post by direct recruitment or re-employment before the age of superannuation shall be on probation for such period as specified in the recruitment rules for that post. (2) The period of probation and other conditions of service relating thereto in respect of the employees appointed on direct recruitment or promotion or re-employment before the age of superannuation shall be as applicable to the officers and employees of the Central Government drawing corresponding scales of pay. 8. Commencement of service. The service of an employee appointed on direct recruitment or re- employment before the age of superannuation shall commence from the working day on which an employee reports for duty on being appointed to a post in the Central Board, at the place intimated to him by the appointing authority, provided that he reports for duty in the forenoon, otherwise his service shall commence from the next working day. 9. Pay, leave, provident fund, retirement age and allowances, etc.—(1) The scales of pay in respect of the posts specified in column (2) of the First Schedule, shall be as specified in column (3) of that Schedule. (2) The Central Civil Services (Leave) Rules, 1972, applicable to the officers and employees of the Central Government, shall be applicable to the employees of the Central Board drawing corresponding scales of pay. (3) The General Provident Fund (Central Services) Rules, 1960, applicable to the officers and employees of the Central Government, shall be applicable to the employees of the Central Board drawing corresponding scales of pay. (4) The age of retirement for the employees of the Central Board shall be such as may be prescribed by the Central Government in respect of the officers and employees of the Central Government drawing corresponding scales of pay in accordance with rule 56 of the Fundamental Rules. (5) The employees of the Central Board shall be entitled to such allowances including travelling allowance and concessions, as admissible from time to time to the officers and employees of the Central Government drawing corresponding scales of pay. 10. Pensionary benefits.- (1) All regular employees of the Central Board who entered service on or before the 31st December, 2003, other than the Officers appointed under sub-section (1) and (2) of section 5D of the Act, shall be entitled to the benefits of pension, commutation of pension, family pension, death- cum-retirement gratuity and service gratuity as applicable to the officers and employees of the Central Government under the Central Civil Services (Pension) Rules, 2021. Provided that in the matter of the pensioners of the Central Board, consultation with the Union Public Service Commission, as provided under first proviso to sub-rule (1) of rule 8 of Central Civil Services (Pension) Rules, 2021, before passing final orders, shall not be applicable. (2) The Central Civil Services (Implementation of National Pension System) Rules, 2021 and the Central Civil Services (Payment of Gratuity under the National Pension System) Rules, 2021 shall be applicable in the case of regular employees of the Central Board who have entered service on or after the 1st January, 2004. Provided that in the matter of such retired employees of Central Board, consultation with Union Public Service Commission as provided under the first proviso to sub-rule (1) of rule 5 of the Central Civil Services (Payment of Gratuity under National Pension System) Rules, 2021, before passing final orders, shall not be applicable. (3) An employee, who sustains an injury or dies as a result of an injury or dies in the course of or as a consequence of the performance of his duty, may be awarded an extraordinary pension on the same scale and subject to the same conditions as laid down in the Central Civil Services (Extraordinary Pension) Rules, 2023 of the Central Government, as in force on the date of the publication of these regulations, and also subject to such modification as may be adopted by the Central Board with the approval of the Central Government. (4) In the case of employees of the Central Board, the powers and functions of the authorities as prescribed in the Central Civil Services (Pension) Rules, 2021 shall be exercised by the officers or authorities of the Central Board for the purposes of this regulation, as per written orders issued from time to time by the Central Provident Fund Commissioner with the approval of the Chairman, Central Board. 11. Resignation, termination, etc.—(1) Notwithstanding anything contained in these regulations, a permanent employee shall not leave or discontinue his service without giving three months' notice, in writing of his intention to do so, to the appointing authority and subject to the acceptance of the same by the appointing authority. (2) Notwithstanding anything contained in these regulations, a temporary employee shall not leave or discontinue his service without giving one month's notice, in writing of his intention to do so, to the appointing authority. (3) The services of a temporary employee may be terminated by the appointing authority without assigning any reason thereof, at any time, after giving him one month's notice: Provided that the services of any such employee may be terminated forthwith and on such termination the employee shall be entitled to claim a sum equivalent to his pay and allowances for the period of notice at the same rates at which he was drawing immediately before the termination of his service, or as the case may be, for the period by which such notice falls short of one month. (4) The rules or instructions, as may be applicable to the officers and employees of the Central Government drawing the corresponding scales of pay in respect of resignation or termination, shall be applicable to the employees of the Central Board referred to in sub-regulations (1), (2) and (3). 12. Control and discipline. — (1) All employees of the Central Board shall be subject to the general superintendence and control of the Chairman, Central Board. (2) Without prejudice to the provisions of these regulations, the conduct and discipline in respect of all employees of the Central Board, except Central Provident Fund Commissioner, Financial Advisor and Chief Accounts Officer, Chief Vigilance Officer and such other officers appointed by the Central Government on deputation basis, shall be governed by the Central Civil Services (Conduct) Rules, 1964, as may be applicable to the officers and employees of the Central Government drawing corresponding scale of pay, or as the Chairman, Central Board may, from time to time, by general or special order, specify. (3) The appointing authority, disciplinary authority, and appellate authority for each post in the Central Board shall be such as specified in columns (4), (5) and (7) of the Second Schedule and the powers related to conduct, discipline and control of the employees of the Central Board shall be exercised by the officer as specified in the said Schedule. 13. Suspension.— (1) The appointing authority, or any authority to which the appointing authority is subordinate, or the disciplinary authority, or any other authority empowered in that behalf by the Central Board may, by general or special order, place an employee of the Central Board under suspension- (a) where a disciplinary proceeding against him is contemplated or is pending; or (b) where, in the opinion of the said authority, he has engaged himself in activities prejudicial to the interests of the Central Board or the security of the State; or (c) where a case against him in respect of any criminal offence is under investigation, inquiry or trial: Provided that where the order of suspension is made by an authority subordinate to the appointing authority, such authority shall forthwith report to the appointing authority, the circumstances in which the order was made. (2) An employee of the Central Board shall be deemed to have been placed under suspension by an order of the appointing authority- (a) with effect from the date of his detention, if he is detained in custody, whether on a criminal charge or otherwise, for a period exceeding forty-eight hours; (b) with effect from the date of his conviction, if, in the event of conviction for an offence, he is sentenced to a term of imprisonment exceeding forty-eight hours and is not forthwith dismissed or removed or compulsorily retired consequent to such conviction. Explanation. For the purposes of clause (b), the period of forty-eight hours shall be computed from the commencement of the imprisonment after the conviction and for this purpose, intermittent periods of imprisonment, if any, shall be taken into account. (3) Where a penalty of dismissal, removal or compulsory retirement from service imposed upon an employee under suspension is set aside in appeal or on review under these regulations and the case is remitted for further inquiry or action or with any other directions, the order of his suspension shall be deemed to have been continued in force, on and from the date of the original order of dismissal, removal or compulsory retirement and shall remain in force until further orders. (4) Where a penalty of dismissal, removal or compulsory retirement from service imposed upon an employee is set aside or declared or rendered void in consequence of or by a decision of a court of law and the disciplinary authority, on a consideration of the circumstances of the case, decides to hold a further inquiry against him on the allegations on which the penalty of dismissal, removal or compulsory retirement was originally imposed, the employee shall be deemed to have been placed under suspension by the appointing authority from the date of the original order of dismissal, removal or compulsory retirement and shall continue to remain under suspension until further orders: Provided that no such further inquiry shall be ordered unless it is intended to meet a situation where the Court has passed an order purely on technical grounds without going into the merits of the case. (5)(a) Subject to the provisions contained in sub-regulation (7), any order of suspension made or deemed to have been made under this regulation shall continue to remain in force until it is modified or revoked by the authority competent to do so. (b) Where an employee is suspended or deemed to have been suspended (whether in connection with any disciplinary proceeding or otherwise), and any other disciplinary proceeding is commenced against him during the continuance of that suspension, the authority competent to place him under suspension may, for reasons to be recorded by him in writing, direct that the employee shall continue to be under suspension until the termination of all or any of such proceedings. (c) An order of suspension made or deemed to have been made under this regulation may at any time be modified or revoked by the authority which made or is deemed to have made the order or by any authority to which that authority is subordinate. (6)(a) an order of suspension made or deemed to have been made under these regulations shall be reviewed by the authority which is competent to modify or revoke the suspension, before expiry of a period of ninety days from the effective date of suspension, on the recommendation of the Review Committee constituted for the purpose and pass orders either extending or revoking the suspension. (b) subsequent reviews shall be made before expiry of the extended period of suspension and the extension of suspension shall not be for a period exceeding one hundred and eighty days at a time. (c) an employee placed under suspension or deemed to have been placed under suspension by an order of the appointing authority shall not be entitled to any pay but is entitled to a subsistence allowance as per rules or instructions issued by the Government of India from time to time. (7) An order of suspension made or deemed to have been made under sub-regulation (1) or sub-regulation (2) shall not be valid after a period of ninety days unless it is extended after review, for a further period before the expiry of ninety days: Provided that no such review of suspension shall be necessary in the case of deemed suspension under sub-regulation (2), if an employee continues to be under detention and in such case the period of ninety days' shall be computed from the date the employee detained in custody is released from detention or the date on which the fact of his release from detention is intimated to his appointing authority, whichever is later: Provided further that in a case where no chargesheet is issued under these regulations, the total period under suspension or deemed suspension, as the case may be, including any extended period in terms of sub-regulation (6) shall not exceed- (a) two hundred and seventy days from the date of order of suspension, if the employee is placed under suspension in terms of clause (a) of sub-regulation (1); or (b) two years from the date of order of suspension, if the employee is placed under suspension in terms of clause (b) or clause (c) of sub-regulation (1), as the case may be; or (c) two years from the date the employee detained in custody is released or the date on which the fact of his release from detention is intimated to his appointing authority, whichever is later, in the case of deemed suspension under sub-regulation (2). 14. Penalties. The following penalties may, for good and sufficient reason and as hereinafter provided, be imposed on an employee of the Central Board, namely:-Minor penalties: (i) censure; (ii) withholding of his promotion; (iii) recovery from his pay of the whole or part of any pecuniary loss caused by him to the Central Board by negligence or breach of orders; (iv) reduction to a lower stage in the time-scale of pay by one stage for a period not exceeding three years, without cumulative effect and not adversely affecting his pension; (v) withholding of increments of pay. Major penalties: (vi) save as provided for in clause (iv), reduction to a lower stage in the time-scale of pay for a specified period, with further directions as to whether or not the employee shall earn increments of pay during the period of such reduction and whether on the expiry of such period, the reduction shall or shall not have the effect of postponing the future increments of his pay; (vii) reduction to lower time-scale of pay, grade, post or service for a period to be specified in the order of penalty, which shall be a bar to the promotion of the employee during such specified period to the time- scale of pay, grade, post or service from which he was reduced, with direction as to whether or not, on promotion on the expiry of the said specified period – (a) the period of reduction to time-scale of pay, grade, post or service shall operate to postpone future increments of his pay, and if so, to what extent; and (b) an employee shall regain his original seniority in the higher time scale of pay, grade, post or service; (viii) compulsory retirement; (ix) removal from service which shall not be a disqualification for future employment under the Central Board; (x) dismissal from service which shall ordinarily be a disqualification for future employment under the Central Board: Provided that, in every case in which the charge of possession of assets disproportionate to known- sources of income or the charge of acceptance from any person of any gratification, other than legal remuneration, as a motive or reward for doing or forbearing to do any official act is established, the penalty mentioned in clause (ix) or clause (x) shall be imposed: Provided further that in any exceptional case and for special reasons recorded in writing, any other penalty may be imposed. Explanation.-— For the purposes of this regulation, the following shall not amount to a penalty, namely:— (a) withholding of increments of pay of an employee for his failure to pass any departmental examination in accordance with the regulations or orders governing the post which he holds or the terms of his appointment; (b) non-promotion of an employee, whether in a substantive or officiating capacity, after consideration of his case, by a duly constituted departmental promotion committee to a grade or post for promotion to which he is eligible; (c) reversion of an employee officiating in a higher grade or post to a lower grade or post, on the ground that he is considered by a duly constituted departmental promotion committee to be unsuitable for such higher grade or post or on any administrative ground unconnected with his conduct; (d) reversion of an employee, appointed on probation to any other grade or post, to his permanent grade or post during or at the end of the period of probation in accordance with the terms of his appointment or the regulations and orders governing such probation; (e) replacement of the services of an employee, whose services had been borrowed from the Central Government or State Government or any authority under the control of the Central Government or State Government, at the disposal of the Central Government or State Government or the authority from which the services of such an employee had been borrowed; (f) compulsory retirement of an employee in accordance with the provisions relating to his superannuation or retirement; (g) termination of the services— (i) of an employee appointed on probation, during or at the end of the period of his probation, in accordance with the terms of his appointment or the regulations and orders governing such probation; or (ii) of a temporary employee in accordance with the provisions of regulation 11; or (iii) of an employee, employed under an agreement, in accordance with the terms of such agreement; (h) any compensation awarded on the recommendation of the Complaints Committee established in the Central Board for inquiring into any complaint of sexual harassment within the meaning of rule 3C of the Central Civil Services (Conduct) Rules, 1964. 15. Disciplinary authority and the authority to institute disciplinary proceedings.- (1) The disciplinary authority in respect of post under the Central Board are as specified in column (5) of the Second Schedule to these regulations. (2) A disciplinary authority, competent under these regulations to impose any of the penalties specified in clauses (i) to (v) of regulation 14, may institute disciplinary proceedings against any employee for the imposition of any of the penalties specified in clauses (vi) to (x) of the said regulation, notwithstanding that such disciplinary authority is not competent under these regulations to impose any of the penalties specified in clauses (vi) to (x). Explanation. For the purposes of this regulation, where an employee holding a post in any scale of pay is promoted, whether on probation or temporarily to the post of the next higher scale, he shall be deemed for the purpose of this regulation to hold the post of such higher scale. 16. Procedure for imposing Penalties. —(1) The procedure for imposing penalties prescribed under regulation 14 shall be the same as provided under the relevant provisions of the Central Civil Services (Classification, Control and Appeal) Rules, 1965. (2) Where the procedure referred to in sub-regulation (1) provides for appointment of serving or retired Central Government employees for any purpose, such as, Inquiry Officer, Presenting Officer, Defence Assistant, then the serving or retired employees of the Central Board shall also be considered for the same. (3) The competent authorities for the purpose of imposing penalties in respect of the posts in the Central Board shall be as specified in the Second Schedule: Provided that consultation with the Union Public Service Commission as provided under the relevant provisions of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 shall not be applicable in the case of employees of the Central Board. 17. Provisions regarding Officials on deputation to Central Government, State Government etc.— (1) Where the services of an employee are lent by the Central Board to the Central Government, State Government or any other authority (hereafter in this regulation referred to as the borrowing authority), the borrowing authority shall have the powers of the appointing authority for the purpose of placing such an employee under suspension and of the disciplinary authority for the purpose of conducting a disciplinary proceeding against him: Provided that the borrowing authority shall forthwith inform the Central Board (hereafter in this regulation referred to as the lending authority) of the circumstances leading to the order of suspension of such employee or the commencement of the disciplinary proceeding, as the case may be. (2) In the light of the findings in the disciplinary proceedings conducted against the employee (i) if the borrowing authority is of the opinion that any of the penalties specified in clauses (i) to (v)of regulation 14 should be imposed on the employee, it may, after consultation with the lending authority, make such orders in the case, as it deems necessary: Provided that in the event of a difference of opinion between the borrowing authority and the lending authority, the services of the employee shall be placed at the disposal of the lending authority; (ii) if the borrowing authority is of the opinion that any of the penalties specified in clauses (vi) to (x) of regulation 14 should be imposed on the employee, it shall place his services at the disposal of the lending authority and forward to the lending authority, the proceedings of the inquiry and thereupon, the lending authority may, if it is the disciplinary authority, pass such order thereon as it may deem necessary, or if it is not the disciplinary authority, submit the case to the disciplinary authority which shall pass such orders in the case as it may deem necessary: Provided that before passing any such order the disciplinary authority shall comply with the provisions of regulation 16. Explanation. For the purposes of this clause, the disciplinary authority may make an order under on the record of the inquiry forwarded to it by the borrowing authority, or after holding such further inquiry as it may deem necessary, as far as may be, in accordance with the provisions of regulation 16. 18. Provisions regarding Officials on deputation to Central Board.—(1) Where an order of suspension is made or a disciplinary proceeding is conducted against an employee of the Central Board(hereafter in this regulation referred to as borrowing authority) whose services have been borrowed from the Central Government or the State Government or local authority, the authority lending his service (hereafter in this regulation referred to as the lending authority) shall forthwith be informed of the circumstances leading to the order of suspension of the employee or of the commencement of the disciplinary proceeding, as the case may be. (2) In the light of the findings in the disciplinary proceeding conducted against the employee, if the disciplinary authority is of the opinion that any of the penalties specified in clause (i) to (v) of regulation 14 be imposed on him, the disciplinary authority may, subject to the provisions of regulation 16, after consultation with the lending authority, pass such orders in the case as it may deem necessary. (3) In the event of a difference of opinion between the borrowing authority and the lending authority, the services of the employee shall be placed at the disposal of the lending authority. (4) If the disciplinary authority is of the opinion that any of the penalties specified in clauses(vi) to (x) of regulation 14 be imposed on the employee, it shall place the services of such employee at the disposal of the lending authority, forwarding to it, the proceedings of the inquiry for such action as it may deem necessary. 19. Orders against which appeal lies.—Subject to the provisions of regulation 20, an employee of the Central Board, may prefer an appeal against all or any of the following orders, namely :- (i) an order of suspension made or deemed to have been made under regulation 13; (ii) an order imposing any of the penalties specified in regulation 14 whether made by the disciplinary authority or by any appellate or revising authority; (iii) an order enhancing any penalty imposed under regulation 14; (iv) an order which - (a) denies or varies to his disadvantage, his pay, allowances, pension or other conditions of service as regulated by these regulations or by agreement; or (b) interprets to his disadvantage the provisions of any such regulation or agreement; (v) an order (a) reverting him while officiating in a higher grade or post to a lower grade or post, otherwise than as a penalty; (b) reducing or withholding the pension or denying the maximum pension admissible to him under these regulations; (c) determining the subsistence and other allowances to be paid to him for the period of suspension or for the period during which he is deemed to be under suspension or for any portion thereof; (d) determining his pay and allowances (i) for the period of suspension, or (ii)for the period from the date of his dismissal, removal or compulsory retirement from service or from the date of his reduction to a lower grade, post, time-scale or stage in a time scale of pay, to the date of his reinstatement or restoration to his grade or post, or (e) determining whether or not the period from the date of his suspension or from the date of dismissal, removal, compulsory retirement or reduction to a lower grade, post, time-scale of pay or stage in a time scale of pay to the date of his reinstatement or restoration to his grade or post shall be treated as a period spent on duty for any purpose. Explanation. For the purposes of these regulations, the expressions (i) "employee of the Central Board" includes a person who has ceased to be in the service of the Central Board; (ii) "pension" includes additional pension, gratuity and any other retirement benefit. 20. Appeal. Notwithstanding anything contained in these regulations, no appeal shall lie against- (i) any order made by the Central Government; (ii) any order of an interlocutory nature or of the nature of a step-in-aid or the final disposal of a disciplinary proceeding, other than an order of suspension; (iii) any order passed by an inquiring authority in the course of an inquiry conducted under regulation 16. 21. Appellate authority.—(1) An employee of the Central Board, including a person who has ceased to be in the service of the Central Board, may prefer an appeal against all or any of the orders specified in regulation 19 to the appellate authority specified in this behalf either in the Second Schedule; or by a general or special order of the Chairman, Central Board, or where no such authority is specified- (a) to the appointing authority, where the order appealed against is made by an authority subordinate to it; or (b) to the Central Government, where such order is made by the Chairman (Central Board). 22. Submission and consideration of appeal.—An appeal under regulation 19 shall be submitted and shall be entertained and considered by the appellate authority specified in regulation 21 in such form and manner, and in accordance with the procedure specified in the Central Civil Services (Classification, Control and Appeal) Rules, 1965. 23. Implementation of orders in appeal.—The authority which made the order appealed against shall give effect to the orders passed by the appellate authority. 24. Revision.—(1) Notwithstanding anything contained in these regulations,— (i) the Central Government; or (ii) the Chairman (Central Board); or (iii) the Central Provident Fund Commissioner; or (iv) an appellate authority, as specified in column(7) of the Second Schedule, within a period of six months from the date of the order proposed to be revised; or (v) any other authority or office of the Central Board specified in this behalf by the Chairman, Central Board by a general or special order, and within such time as may be specified in such general or special order, may at any time, either on its own motion or otherwise call for the records of any inquiry and revise any order made under these regulations, provided that no appeal has been preferred or from which no appeal is allowed against that order, and may, (a) confirm, modify or set aside the order; or (b) confirm, reduce, enhance or set aside the penalty imposed by the order, or impose any penalty, where no penalty has been imposed; or (c) remit the case to the authority which made the order to or any other authority directing such authority to make such further enquiry as it may consider proper in the circumstances of the case; or (d) pass such other orders as it may deem fit: Provided that no order imposing or enhancing any penalty shall be made by any revising authority unless the employee of the Central Board has been given a reasonable opportunity of making a representation against the penalty proposed, and where it is proposed, to impose any of the penalties specified in clauses (vi) to (x) of regulation 14 or to enhance the penalty imposed by the order sought to be revised to any of the penalties specified in clauses (vi) to (x) of the said regulation, and if an inquiry under regulation 14 has not already been held in the case, no such penalty shall be imposed except after an inquiry in the manner laid down in regulation 16: Provided further that no power of revision shall be exercised by the authorities specified in clauses (i) to (v), unless— (a) the authority which made the order in appeal; or (b) the authority to which an appeal shall lie, where no appeal has been preferred, is subordinate to him. (2) No proceeding for revision shall be commenced until after— (a) the expiry of the period of limitation for an appeal; or (b) the disposal of the appeal, where any such appeal has been preferred. (3) An application for revision shall be dealt with in the same manner as if it were an appeal under these regulations. 25. Review. The Central Government, may, at any time, either on its own motion or otherwise review any order passed under these regulations, when any new material or evidence which could not be produced or was not available at the time of passing the order under review and which has the effect of changing the nature of the case, has come, or has been brought, to his notice: Provided that no order imposing or enhancing any penalty shall be made by the Central Government unless the employee concerned has been given a reasonable opportunity of making a representation against the penalty proposed or where it is proposed to impose any of the major penalties specified in regulation 14 or to enhance the minor penalty imposed by the order sought to be reviewed to any of the major penalties and if an inquiry under regulation 16 has not already been held in the case, no such penalty shall be imposed except after inquiring in the manner laid down in regulation 16. 26. Conduct of employees.—The Central Civil Services (Conduct) Rules, 1964, as applicable to the employees of the Central Government, shall mutatis mutandis apply to the employees of the Central Board drawing corresponding scales of pay. 27. Transfer liability.— Every employee of the Central Board shall be liable to serve anywhere in India in any office of the Central Board. 28. Other conditions of service. —In respect of all other matters relating to the conditions of service of the employees, for which no provision or insufficient provision has been made in these regulations, the rules applicable from time to time to the officers and employees of the Central Government drawing corresponding scales of pay shall apply: Provided that where the Central Board is of the opinion that it is necessary to make departure from the rules or orders of the Central Government in respect of any matter under this regulation, it shall obtain prior approval of the Central Government. 29. Competent authority for application of Central Government rules. For the purposes of application of the corresponding Central Government rules to the employees of the Central Board under these regulations, the Chairman, Central Board shall be the competent authority to exercise all the powers and functions vested in the President. 30. Authority to authenticate order of the Chairman, Central Board. The orders passed by the Chairman, Central Board (including orders passed in disciplinary matters) shall be authenticated by an officer not below the level of Additional Central Provident Fund Commissioner. 31. Relaxation in exceptional cases.—Where the Central Provident Fund Commissioner is satisfied that the operation of any of the regulations or provisions in the matter of conditions of service of an employee causes undue hardship in any particular case, he may, with the prior approval of the Chairman, Central Board, by order, dispense with or relax any of the requirements of that regulation or provision, and subject to such conditions as may be considered necessary for dealing with the case, in a just and equitable manner: Provided that any such deviation or relaxation shall not exceed the extant provisions of the Central Government rules or instructions applicable to the officers and employees of the Central Government drawing corresponding scales of pay. 32. Service of Orders, Notice etc. Every order, notice and other process made or issued under these regulations, shall be served in person on the employee concerned or communicated to him by registered post or speed post or official electronic communication. 33. Power to relax time-limit and to condone delay. Save as otherwise expressly provided in these regulations, the authority competent under these regulations to make any order may, for good and sufficient reasons, extend the time specified in these regulations for anything required to be done thereunder, or condone any delay. 34. Protection of rights and privileges conferred by law or agreement. Nothing in these regulations shall operate to deprive any employee of any right or privilege to which he is entitled: (a) by or under any law for the time being in force, or (b) by the terms of any agreement subsisting between such person and the Employees' Provident Fund Organisation. 35. Saving. Nothing in these regulations shall affect reservations and other concessions in appointments to various posts in the organisation required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-Servicemen and other special categories of person in accordance with the orders issued by the Central Government from time to time in this regard. 36. Removal of doubts. If any doubt arises as to the interpretation of any of the provisions of these regulations, the matter shall be referred to the Central Provident Fund Commissioner or such other authority, as may be specified by the Central Provident Fund Commissioner, by a general or special order; and accordingly, the Central Provident Fund Commissioner or such authority shall decide the same.
