Under Section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the Ministry of Road Transport and Highways (S.O. 3786(E), dated 23 August 2023) levies user fees on mechanical vehicles for the National Highways Authority of India, entrusted under Section 7 of the National Highways Authority of India Act, 1988 (68 of 1988) via S.O. 1423(E) dated 5 May 2017 and S.O. 1505(E) dated 14 May 2020, to collect on NH-209 (New NH-83) across the Kamalapuram-Oddanchatram, Oddanchatram Bypass, Oddanchatram-Madathukulam, Madathukulam-Pollachi and Pollachi-Coimbatore sections in Dindigul and Coimbatore districts, Tamil Nadu, covering a net road length of 39.114 km plus 35.640 km equivalent structure length and 111.792 km of bypasses. Base-year (2007-08) rates per km range from Rs. 0.65 for cars/light vehicles to Rs. 4.20 for oversized vehicles (seven or more axles), collected at three fee plazas -- Km 12.000 near Paraipatti Village, Km 40.500 near Chatrapatti Village, and Km 97.200 near Gomangalam Puthur Village -- with an additional 150% surcharge for bypasses (Dindigul, combined Oddanchatram-Chatrapatti-Palani, Udumalpet, Pollachi bypasses) costing Rs. 10 crore or more, and 100% base rates for structures over 60m converted via a 10x equalisation factor. The monthly non-commercial pass is fixed at Rs. 330 for 2023-24, multi-journey passes are set at one-and-a-half times the single fare for two journeys or two-thirds of the fifty-journey fare for fifty trips within one month, and a 50% concessional rate applies to locally registered commercial vehicles where no alternative road exists. The estimated project capital cost is Rs. 5,439.76 crore (broken down by section), and fees are to be reduced to 40% of the base rates after capital cost recovery. No. 1423(E) dated 05th May, 2017 a nd S.O. No. 1505(E) dated 14th May, 2020 issued under section 11 of the National Highways Authori ty of India Act, 1988 (68 of 198 8), the Central Government has entrusted the work of NH No. 209 [Pollachi to Coimbatore section (in the State of Tamil N adu) fr om Km . 123.550 to Km. 150.400) a nd the work of New NH No. 83 (Old NH -209) [From existing chainage 390.400 of NH -7 (New NH - 44) near Kamalapuram -Lakkayankottai (Oddanchatram Bypass) - Virupatchi (Oddanchatram Bypass) -Vedapatti – existing chainage 125.3 00 of N H-209 (New NH -83) near Achipatti – Anjinayar Kovil] respectively to the National Highways Authority of India (hereinafter referred to as the “Authority”); Now, therefore in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (4 8 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and subsequent amendments (hereinafter referred to as the “rules”), the Central Government hereby levies the fee on mechanical vehicles at the rat e specified in column (2) of Ta ble 1 for net road section length of 39.114 Km. and for equivalent structure length (having length more than 60m) of 35.640 Km . The rate of monthly pass for a person who owns a mechanical vehicle registered for non -commercial purpose and resides within a distance of twenty kilometers from the fee plaza is Rs. 330/ - (Rupees Three Hundred and Thirty only) f or the year 2023 -2024 and i s subject to revision every year as per the provisions of said rules. 5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: - Table -5 Amount Payable Maximum number of one -way journey s allowed Period of validity One and one -half times of the fee for one way journey Two Twenty four hours from the time of payment Two-third of amount of the fee payable for fifty single journeys Fifty One month from the date of payment 6. Fee for co mmercia l vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of suc h comme rcial vehi cles. 7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee co llecting agency, equal to the fee specified in sub -rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including cat egory o f mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc., shall be as per definitions specified in the said rules. 9. The fee rates shall be displayed for information of the users in accordance wi th rule 12 of the said rules. 10. Based on the base rate of fee per kilometer for the base year 2007 -2008 as mentioned in Table 1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the b asis of the completed length of the section and revised annually in accordance with the Rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 11. The estimated capital cost of the project is Rup ees 5439.76 Crores (Rs. 1090.99 Crores for Kamalapuram - Oddanchatram section, Rs. 284.95 Crores for Oddanchatram bypass section, Rs. 1592.83 Crores for Oddanchatram - Madathukulam section, Rs. 1516.13 Crores for Madathukulam -Pollachi section and Rs. 954 .87 Cr ores for Pollachi - Coimbatore section). [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc., are yet to be completed and the final capital cost will be notified separately]. The Authorit y shal l maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
