Detailed Summary

The Ministry of Commerce and Industry (Department of Commerce), Directorate General of Trade Remedies, issued a Corrigendum Notification on 16th June, 2025, pertaining to Case No. CVD (OI) – 01/2024. This corrigendum addresses the final finding in the countervailing duty investigation concerning imports of effect pearlescent pigments or mica pearlescent pigments, specifically excluding effect pigments for automotive applications. Having regard to the Customs Tariff Act, 1975, and the Customs Tariff (Identification, Determination and Assessment of Countervailing Duties and Injury) Rules, 1995, the Director General had previously issued the Final Finding Notification F. No. 6/8/2024 – DGTR dated March 28th 2025. This Corrigendum Notification substitutes the clarification issued below the duty table in that previous final finding. The revised clarification states that for effect pearlescent pigments or mica pearlescent pigments of natural grade for industrial application, the countervailing duty shall be the difference between the amount payable as per column (7) and the anti-dumping duty payable as per Customs Notification No. 13/2023-Cus (ADD), dated 22nd November 2023. For natural grade pigments for cosmetic application, the countervailing duty shall be equivalent to the amount payable as per column (7), as no anti-dumping duty is applicable. No countervailing duty should be charged for natural grade pigments for automotive application. Lastly, for synthetic grade pigments, the countervailing duty shall also be equivalent to the amount payable as per column (7), as no anti-dumping duty is applicable. Siddharth Mahajan, the Designated Authority, noted that the customs classification is indicative only and not binding on the scope of the product under consideration.
