L.-33004/99 The Gazette of India CG-DL-E-17102025-266983 EXTRAORDINARY PART II—Section 3—Sub-section (i) PUBLISHED BY AUTHORITY NEW DELHI, THURSDAY, OCTOBER 16, 2025/ ASVINA 24, 1947 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 14th October, 2025 G.S.R. 755(E).—The following draft rules to amend the Compensation to Victims of Hit and Run Motor Accidents Scheme, 2022, which the Central Government proposes to make in exercise of the powers conferred by section 161 and sub-section (4) of section 215 of the Motor Vehicles Act, 1988 (59 of 1988) is hereby published as required by sub-section (1) of Section 212 of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of this notification as published in the Gazette of India, are made available to the public. Objections or suggestions, if any, may be sent to the Additional Secretary (MVL), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001, Email: comments-morth@gov.in. Any objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period aforesaid will be considered by the Central Government. DRAFT RULES 1. Short title and commencement. - (1) These rules may be called as the Compensation to Victims of Hit and Run Motor Accidents (Amendment) Scheme, 2025. (2) It shall come into effect from the date of its publication in the Official Gazette. 2. In the Compensation to Victims of Hit and Run Motor Accidents Scheme, 2022 (hereinafter referred to as the said scheme), in paragraph 2,– (i) the paragraph 2 shall be numbered as sub-paragraph (1); (ii) clauses (b), (c) and (d) of sub-paragraph (1) as so numbered shall be omitted; (iii) for clause (g) of sub-paragraph (1) as so numbered, the following clause shall be substituted, namely, — "(g) "District Road Safety Committee" means a Committee set up under sub-section (3) of section 215 of the Act;"; (iv) after clause (h) of sub-paragraph (1) as so numbered, the following clause shall be inserted, namely, "(ha) "GI Council" means the General Insurance Council constituted under section 64C of the Insurance Act, 1938 (4 of 1938);" (v) after clause (i) of sub-paragraph (1) as so numbered, the following clause shall be inserted, namely, "(ia) "portal" means a web or electronic based system developed and managed by the General Insurance Council for the purpose of this scheme;"; (vi) for clause (j) of sub-paragraph (1) as so numbered, the following shall be substituted, namely, "Fund" means the Motor Vehicle Accident Fund as defined in sub-rule (b) of rule 2 of the Central Motor Vehicles (Motor Vehicle Accident Fund) Rules, 2022;"; (vii) after clause (1) of sub-paragraph (1) as so numbered, the following clause shall be inserted, namely, "(m) "State Road Safety Council" means the Council for a State or Union Territory, as the case may be, constituted under sub-section (2) of section 215 of the Act."; (viii) After clause (1) as so numbered, following clause shall be inserted, namely, "(2) Words and expressions used in this Scheme and not defined herein, but defined in the Act, shall have the meanings respectively assigned to them in the Act." 3. In the said scheme, in paragraph 3, — (i) in clause (d) and (I), for the word 'General Insurance', the word 'GI' shall be substituted; (ii) in clause (h), for the word "Director", the words "an officer not below the rank of Deputy Secretary" shall be substituted. 4. In the said scheme, in paragraph 5, — (i) in clause (a), for the word 'General Insurance', the word 'GI' shall be substituted; (ii) for clause (b), the following shall be substituted, namely, "consider the issues raised by the authority specified under paragraph 13A and provide guidance or directions to concerned officials responsible for implementation of the Scheme, including on prevention of fraud, wherever called for;" (iii) clause (d) shall be omitted; (iv) after clause (d), the following clause shall be inserted, namely, "(e) having regards to the circumstances of the case, if deemed appropriate, make recommendations to the Central Government or State Government for taking appropriate action under clause (b) of sub-section (4) of section 161 of the Act for contravention of provisions of this scheme.” 5. In the said scheme, paragraphs 11 and 12 shall be omitted. 6. In the said scheme, for paragraph 13, the following paragraph shall be substituted, namely, "13. Powers and functions of the District Road Safety Committee. (1) The District Road Safety Committee shall undertake following functions connected with the implementation of this scheme at the District Level, namely: (a) to evaluate the implementation of this scheme in the concerned District and take corrective steps, wherever necessary; (b) to maintain month-wise statistics, including in electronic form, about the claim applications received, awarded or pending and reasons for pendency in the concerned District; (c) to keep close liaison with other authorities in the district so as to ensure that this scheme gets adequate publicity; (d) to provide guidance to claimants, wherever called for; (e) to raise awareness about the rights available to claimants and the provision of compensation under this scheme; and (f) to furnish information in respect of this scheme to the agency or authority specified under paragraph 13A. (2) The concerned Claims Enquiry Officer and the officer nominated under paragraph 19 of this scheme may be invited in the meetings of the District Road Safety Committee whenever the functions provided for in sub-paragraph (1) are undertaken." 7. In the said scheme, after paragraph 13, the following paragraph shall be inserted, namely, — "13A. Monitoring at State Level.- (1) The State Road Safety Council or any other such agency or authority as may be designated by the State Government may undertake following functions connected with the implementation of this scheme in the concerned State or Union Territory, as the case may be, namely, — (a) to evaluate the progress of implementation of this scheme and take corrective steps, wherever necessary; (b) to review month-wise statistics, including in electronic form, about the claim applications received, awarded, pending and reasons for pendency; (c) to issue directions to concerned district authorities for improving the implementation of this scheme; (d) to furnish information or raise implementation related issue to the Central Government or Standing Committee in respect of this scheme.". 8. In the said scheme, paragraphs 14, 15, 16, 17 and 18 shall be omitted. 9. In the said scheme, in paragraph 19, for the word 'General Insurance', the word 'GI' shall be substituted. 10. In the said scheme, in paragraph 20, for sub-paragraph (1), the following shall be substituted, namely, "The applicant shall submit an application seeking compensation under this scheme in Form I, along with an undertaking in Form IV, and such other documents mentioned in Form I, including through electronic means, to the Claims Enquiry Officer of the Sub-Division or Taluka in which the accident took place." 11. In the said scheme, in paragraph 21, — (i) in sub-paragraph (2), in clause (b), after the words “Claims Settlement Commissioner", the words "on the portal" shall be inserted; (ii) in sub-paragraph (3), after the words "report to the Claims Enquiry Officer", the words "on the portal" shall be inserted. 12. In the said scheme, in paragraph 22, — (i) in sub-paragraph (1), — (a) for the words, "Subject to sub-paragraph (2), on", the word "On" shall be substituted; (b) for the words, "and the Forms and documents received from the claimant, to the Trust constituted under rule 4 of the Central Motor Vehicles (Motor Vehicle Accident Fund) Rules, 2022 or the General Insurance Council, as the case may be", the words "to the GI Council, including through the portal, for payment from the Hit and Run Compensation Account of the Fund administered by the Trust constituted under rule 4 of the Central Motor Vehicles (Motor Vehicle Accident Fund) Rules, 2022" shall be substituted; (c) in clause (e), for the words “General Insurance Council headquarters", the words "Member-Secretary, District Road Safety Committee shall be substituted; (ii) sub-paragraph (2) and the provisos thereto shall be omitted. 13. In the said scheme, in paragraph 23, in sub-paragraph (3), — (i) for the word 'General Insurance', the word 'GI' shall be substituted; (ii) words "and the Forms and documents from claimant," shall be omitted. 14. In the said scheme, in paragraph 23, in sub-paragraph (4), after the proviso, following shall be inserted, namely, "Provided further that in case of any deficiency in the particulars furnished by the claimant necessary for making the payment under sub-paragraph (3), including but not limited to bank account details, the GI Council, in coordination with the concerned Claim Settlement Commissioner, may, within the period specified in this sub-paragraph, seek the necessary information from the claimant." 15. In the said scheme, in paragraph 24, for the word ‘General Insurance', the word ‘GI’ shall be substituted. 16. In the said scheme, for Form I, the following Form shall be substituted, namely, “ FORM I [Paragraph 20 (1)] COMPENSATION TO VICTIMS OF HIT AND RUN MOTOR ACCIDENTS SCHEME, 2022 Application Form For grievous hurt case:* I, ....................................son / daughter / spouse of ............................... residing at ......................................... having been grievously injured in hit and run motor vehicle accident on .......................... at ..............................., hereby apply for grant of compensation for the grievous injuries sustained from the Central Government's Motor Vehicle Accident Fund. Necessary particulars in respect of the injury sustained by me are given below:- For death case:* I, ....................................son / daughter / spouse of.......................... residing at ....................................... as a legal representative of ................................... son / daughter / spouse of................................... who died / had sustained injuries in hit and run motor vehicle accident on .......................... at ..............................., hereby apply for the grant of compensation on account of death/injuries from the Motor Vehicle Accident Fund. Necessary particulars in respect of accident and other information are given below:- 1. Name and father's name of person injured / dead (husband's name in case of married woman or widow).... Name and address of the person dead/injured:" the following serial number and entry shall be inserted, namely, — "1b. Contact details of the claimant (mobile number, email ID):"; (iv) after serial number 2 namely, "2. Place, time and date of the accident:", the following serial number and entry shall be inserted, namely,- "2A.
