By notification S.O. 3952(E) dated 5th September 2023, the Ministry of Petroleum and Natural Gas, referencing its earlier declaration of intent S.O. 2189(E) dated 28th April 2022 (published 11th May 2022) under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), and after the Competent Authority's report under sub-section (1) of section 6, declared under sub-section (1) of section 6 of the said Act that the right of user in the land listed in the appended Schedule is acquired for laying a pipeline for transporting oil from Nagra End Point to Laxmipura T-Point via Kathana GGS and Padra GGS (a 10-inch trunk pipeline) in the State of Gujarat. Under sub-section (4) of section 6, the Central Government directed that this right of user vest, on publication, directly in Oil and Natural Gas Corporation Ltd (ONGC) free of encumbrances, with ONGC exclusively liable for compensation under section 10 of the Act. The appended Schedule lists the affected land parcel-by-parcel (survey/block numbers with areas in hectares/ares/sq. metres) across 31 villages: Undel, Bhuvel, Vatra, Vatadara and Kalamsar (Taluka Khambhat, District Anand); Kandhroti and Kathana (Taluka Borsad, District Anand); Dhanavasi, Moti Sherdi, Nani Sherdi, Kinkhlod, Narpura, Jhilod, Bamangam and Chamara (further villages under Taluka Borsad/Padra, District Anand/Vadodara); Jaspur, Luna, Tajpura, Padara (Kasba) and Sangma (Taluka Padra, District Vadodara); and Samiyala (Taluka Vadodara, District Vadodara). NOTIFICATION
New Delhi, the 5th September, 2023

S.O. 3952(E).—Whereas by a notification of the Government of India in the Ministry of Petroleum and Natural Gas S.O. No. 2189 (E) Dated 28th April 2022, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), published in the Extra Ordinary Gazette of India dated the 11th May 2022, the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline in the State of Gujarat for transportation of Oil from Nagra End Point to Laxmipura T-Point (Via Kathana GGS and Padra GGS (10" Trunk Pipeline), should be laid by Oil and Natural Gas Corporation Ltd.

And whereas copies of the said Extra Ordinary Gazette notification were made available to the public up to 3rd September 2022.

And whereas the Competent Authority has under sub-section (1) of section 6 of the said Act submitted report to the Central Government;

And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;

And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Oil and Natural Gas Corporation Ltd free from all encumbrances.

Oil and Natural Gas Corporation Ltd, shall be exclusively liable for any compensation in terms of Section 10 of the P&MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
