Detailed Summary

The Ministry of Road Transport and Highways, through S.O. 4590(E) dated 8th October, 2025, in exercise of powers under section 7 of the National Highways Act, 1956 (48 of 1956) read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008, has superseded notification S.O. 1613(E) dated 16th April 2019. This notification levies a fee for the use of the 65.250 km four or more lane section from km 220.700 to km 285.950 (Srinagar-Qazigund Section) of National Highway number 1A (New NH-44) in the Union Territory of Jammu & Kashmir, authorizing the National Highways Authority of India to collect it. The fee is levied at specified base rates (Table 1) for a net road section length of 32.164 km, for an equivalent structure length of 8.860 km (derived from 0.886 km of structures >60m using an equalization factor of 10), and at one and half times the base rate for bypasses totaling 32.200 km costing rupees ten crore or more. Specific bypasses include Qazigund (3.785 km, Rs. 36.21 crore), Bijbehara (12.165 km, Rs. 117.45 crore), Awantipora (6.28 km, Rs. 60.64 crore), and Pampore (9.97 km, Rs. 87.48 crore). The fee is payable at the Fee Plaza at Design Km 258+564 near village Kaichachkoot in Pulwama district. A monthly pass for non-commercial vehicles owned by residents within 20 km of the fee plaza is Rs 350 for 2025-26. Multiple journey passes are also specified: two journeys within 24 hours for 1.5 times the one-way fee, and fifty journeys within one month for two-thirds of the fifty single journeys' cost. Commercial vehicles registered in the district where the fee plaza falls are eligible for a 50% discount if no service or alternative road is available. Overloaded vehicles are liable to pay a fee equal to that specified in sub-rule 1A of rule 10 of the said rules and cannot use the highway section until the excess load is removed. All definitions are as per the National Highways Fee (Determination of Rates and Collection) Rules, 2008, and fee rates must be displayed per rule 12. Fees will be calculated and revised annually by the Authority per rule 5 and published in English and vernacular newspapers. The estimated capital cost of the project is Rupees 2803.99 crore.

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the fee plaza is Rs 350 (Rupees Three Hundred Fifty only) for the year 2025-26 and is subject to revision every year as per the provisions of the said rules. 5. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the specified rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the fee collecting agency, equal to the fee specified in sub-rule 1A of rule 10 of the said rules, and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road, etc. shall be as per definitions specified in the said rules. 9. The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules. 10. Based on the base rate of fee per kilometer for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper in English and vernacular language. 11. The estimated capital cost of the project is Rupees 2803.99 crore. [The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting, etc. are yet to be completed.
