L.-33004/99 The Gazette of India CG-DL-E-09012025-260072 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 132] NEW DELHI, TUESDAY, JANUARY 7, 2025/PAUSHA 17, 1946 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 7th January, 2025 S.O. 134 (E).β€”In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Madhya Pradesh (hereinafter referred to as the Authority) comprising of the following Members, namely:β€” (i) Shri Shiv Narayan Singh Chauhan, - Chairman; 22, Rishi Nagar, Char Imli Bhopal 462016 (ii) Dr. Sunanda Singh Raghuwanshi, - Member; and E7/59, S.B.I. Colony Arera Colony, Bhopal-16 (iii) Executive Director, - Member Secretary. Environmental Planning and Coordination Organization, Bhopal 2. The Chairman and Members of the Authority shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 3. The Authority shall exercise such powers and follow such procedures as specified in the said notification. 4. The Authority shall take its decision on the recommendations of the State Level Expert Appraisal Committee constituted under paragraph 6 for the State of Madhya Pradesh. 5. All decisions of the Authority shall be taken in a meeting and shall ordinarily be unanimous: Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to the Central Government. 6. The Central Government, in consultation with the State Government of Madhya Pradesh, for the purpose of assisting the Authority, hereby constitutes the State Level Expert Appraisal Committee, Madhya Pradesh (hereinafter referred to as the Committee), comprising of the following Members, namely:β€” (i) Shri Rakesh Kumar Shrivastava, - Chairperson; 62, Shiva Royal Court, Near Mahindra Township, Rohit Nagar, Bawadia Kalan, Bhopal (ii) Shri Vijay Kumar Ahirwar, - Member; E8, House No. 199, Trilanga Colony, Bhopal- 462039 (iii) Dr. Rakesh Kumar Pandey, - Member; Nalanda Building, Makhanalal Chaturvedi National University of Journalism and Communication Bhopal, Opposite MP State Shooting Academy Makhanpuram, Bishankhedi, Bhopal – 462044 (iv) Dr. Pallavee Bhatnagar, - Member; 103, Ram Bhavan, Berkhedi Road, Jehangirabad Bhopal , (v) Dr. Sunita Singh, - Member; H. The Chairperson and Members of the Committee shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 8. The Committee shall exercise such powers and follow such procedure as specified in the said notification. 9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail. 10. In order to avoid any conflict of interest,- (i) the Chairman and Members of the Authority and the Chairperson and Member of the Committee shall,- (a) declare to which consulting organisation they have been associated with and also the project proponents; (b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority or to be appraised by the Committee during their tenure; and (ii) if the Chairman or Member of the Authority or the Chairperson or Member of the Committee has provided consultancy services or conducted Environment Impact Assessment studies for any project proponent during the preceding five years, in that event they shall recuse themselves from the meetings of the Authority or the Committee in the process of appraisal of any project proposed by such proponents. 11. The State Government of Madhya Pradesh shall specify an agency to act as Secretariat for the Authority and the Committee and the Secretariat shall provide financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification. 12. The sitting fee, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Chairperson and Member of the Committee shall be paid in accordance with the provisions of relevant rules of the State Government of Madhya Pradesh.
