Detailed Summary

The Ministry of Environment, Forest and Climate Change, exercising powers conferred by section 62 of the Biological Diversity Act, 2002 (18 of 2003), issued G.S.R. 295(E) on 6th May, 2025, to further amend the Biological Diversity Rules, 2024. These rules, called the Biological Diversity (Amendment) Rules, 2025, shall come into force from the 1st day of November, 2025. Rule 19 of the Biological Diversity Rules, 2024 is substituted with a new rule detailing the procedure for obtaining a certificate of origin for cultivated medicinal plants. As per the new Rule 19, Biodiversity Management Committees shall maintain books detailing cultivated medicinal plants in Form 11 on a web portal. Applications for certificates of origin under sub-section 2 of section 7 of the Act shall be made in Form 11A on the web portal along with the prescribed fee. The certificate of origin will be generated in Form 12 on the web portal based on the entries in Form 11. The First Schedule of the rules is amended to substitute entries for serial numbers 11 and 12, introducing a fee of 200 for the 'Application for obtaining certificate of origin for cultivated medicinal plants' (Sl. No. 11A), while maintaining 'Nil' fee for maintaining books (Sl. No. 11) and issuing the certificate (Sl. No. 12). The Second Schedule is amended to substitute Form-11 and Form-12 with new Forms 11, 11A, and 12, providing formats for the book of details, the application for certificate of origin, and the certificate of origin itself, respectively. MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 6th May, 2025 G.S.R. 295(E).—In exercise of the powers conferred by section 62 of the Biological Diversity Act, 2002 (18 of 2003), the Central Government hereby makes the following rules further to amend the Biological Diversity Rules, 2024, namely :— (1) These rules may be called the Biological Diversity (Amendment) Rules, 2025. (2) They shall come into force from the 1st day of November, 2025. 2. For Rule 19 of the Biological Diversity Rules, 2024, (hereinafter referred to as the said rules), the following rule shall be substituted, namely, – 19. Procedure for obtaining a certificate of origin for cultivated medicinal plants. – (1) Books containing the details of cultivated medicinal plants shall be maintained by the Biodiversity Management Committee in Form 11 in the web portal. (2) An application for obtaining certificate of origin under sub-section 2 of section 7 of the Act shall be made to the Biodiversity Management Committee along with the fee in Form 11A on web portal. (3) On the basis of the entries made in the books maintained under sub-rule (1), the certificate of origin shall be generated in the web portal in the Form '12'. 3.
